MONTAGUE TOWNSHIP COMMITTEE MEETING,

February 13,2001

Minutes

 

Mayor Butto called the session to order at 8:04 p.m. and opened the meeting, stating that the meeting was being held in compliance with the Open Meetings Act, P>L> 1975, c. 231, and has been duly advertised.

The Clerk was asked to call the roll.

Present were: Committeewoman Kaman Committeeman Zitone

Committeeman Barbagallo, Committeeman Krebs

Atty. Edelstein, Clerk Felter

Absent: None

All present were asked to join in the Pledge of Allegiance.

Approval of Minutes January 9,2001 Regular Meeting

January 9,2001 Executive Session

Committeeman Zitone made a motion to approve the above mentioned minutes.

Committeewoman Kaman Seconded the motion.

The motion was approved by a unanimous voice vote

Ordinances

Second Reading:

Ord. 2001-11 An Ordinance to Amend Article XIV Being the Conditional Use Section of the Montague Township Land Use Ordinance to Conditionally Permit and Regulate the Installation of Wireless Telecommunications Towers, Equipment and Facilities

Public Hearing:

Committeeman Krebs made a motion to open the Public Hearing.

Committeeman Zitone seconded the motion.

The motion was carried by a unanimous voice vote.

There was no comment from the public.

Committeeman Zitone made a motion to close the Public Hearing.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous voice vote.

Committeeman Zitone made a motion to adopt Ord. 2001-011.

Committeeman Krebs seconded the motion.

First Reading:

Ord. 2001-012 An Ordinance Amending Chapter 54A of the Code of the Township of Montague Entitled ARental Properties@

Committeeman Zitone made a motion to adopt Ord. 2001-012 on first reading.

Deputy Mayor Barbagallo seconded the motion.

The motion was carried by a unanimous roll call vote:

First Reading:

Ord. 2001-013 An Ordinance Amending Chapter 2 of the Code of the Township of Montague to Amend Ordinance Nos. 95-7, 98-03

Entitled AEstablishment of a Board of Recreation Commissioners@

Committeeman Zitone made a motion to adopt Ord. 2001-013 on first reading.

Deputy Mayor Barbagallo seconded the motion.

The motion was carried by a unanimous roll call vote:

Deputy Mayor Barbagallo made a motion to adopt the above mentioned Resolutions.

Committeeman Zitone seconded the motion.

New Business

Clean Water Financing

Committeeman Zitone advised the Committee that the Grant/Loan Application had been sent to Jack O=Krepky, the Township=s engineer, for review. Mr. O=Krepky in turn advised Committeeman Zitone that the Township did not qualify for a grant but only for a low interest loan. There is a possibility that this Grant/Loan application could be forwarded on to the Board of Trustees of the High Point Community Corporation and they could look into doing something with it.

Resignation:

William T. Haggerty-Montague Municipal Prosecutor

The Committee accepted Mr. Haggerty=s letter of resignation with regret.

Appointments:

Mark J. Hontz-Montague Municipal Prosecutor

Committeeman Zitone made a motion to appoint Mark J. Hontz as the Township of Montague=s Municipal Prosecutor under the same terms as Mr. Haggerty servered.

Committeewoman Kaman seconded the motion.

The motion was carried by a roll call vote:

Louanne Cular-Emergency Management Deputy (paid)

Jesse Brace-Emergency Management Deputy (volunteer)

Committeeman Zitone made a motion to table action on the appointments of Louanne Cular & Jesse Brace.

Deputy Mayor Barbagallo seconded the motion.

The motion was carried by a unanimous voice vote.

Helen F. Felter-Re-appointment as Municipal Clerk

Deputy Mayor Barbagallo made a motion to re-appoint

Helen F. Felter as the Municipal Clerk for the Township of Montague retro-active to February 1, 2001

Committeewoman Kaman seconded the motion.

Appointments to the Advisory Board of Health

Committeewoman Kaman made a motion to appoint the following people to the Advisory Board of Health for one (1) year each.

Debra Mulligan, Alice Thon, Reginald Cole

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous roll call vote:

Appointments to the Industrial & Economic Development Commission:

Committeewoman Kaman made a motion to appoint the following members to the Industrial & Economic Development Commission:

Richard Clauberg, Chaba Pallaghy

Committeeman Barbagallo seconded the motion.

The motion passed on a roll call vote:

Approval of Vouchers - Payment of Bills:

Deputy Mayor Barbagallo made a motion to approve payment of the bills.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous voice vote.

Correspondence:

Tanya N. Helfand, Counselor At Law - New Myrtle Drive

Ms. Helfand, an attorney representing some of the residents of

Ridge Rd.(New Myrtle Drive) wrote a letter voicing the concern of these residents regarding the proposed cost of paving their road.

The Committee requested Mr. Edelstein, Township Attorney, to write a letter advising Ms. Helfand of the fact that there are no

plans at this time to re-pave this road.

Memo: Committeewoman Kaman-Sussex County Law Enforcement Training Facility and Firing Range

Committeewoman Kaman explained to the Committee how important she felt this facility would be for Sussex County. The Committee agreed.

Deputy Mayor Barbagallo made a motion to support a resolution as adopted by other Municipalities regarding a Law Enforcement Training Facility and Firing Range.

Committeewoman Kaman Seconded the motion.

The motion was carried by a unanimous voice vote.

Memo: Committeewoman Kaman-Highway Accident Property Tax Relief Act.

The Committee asked Committeewoman Kaman to check into this proposed legislation and report back to them.

Committeewoman Kaman agreed to do this.

Memo: Committeewoman Kaman-Montague Day

The Committee decided to postpone any discussion or action on the subject of AMontague Day@ until the budget is in place.

Memo: Committeewoman Kaman-HPCC Meeting 2-01-01

Committeewoman Kaman advised the Committee that she attended the meeting of the HPCC of 2-01-01. The Clerk distributed a memo on the business content of the meeting.

Stephen Edelstein, Esq.

Mr. Edelstein, Attoney for the Township

Rasht Suit

Mr. Edelstein advised the Committee that the Rasht Suit no longer involves the Township but is now between Rasht and Cumberland Farms. Judge Stanton has ruled in favor of Rasht, finding that a portion of the Montague Building Ordinance

is unconstitutional. Cumberland Farms is appealing this ruling.

Chant, Shimmer Spring Farm & Gorsky

In this matter, regarding the Cell Tower, Mr. Edelstein will be filing an answer by February 26, 2001.

Foreclosures

Mr. Edelstein requested permission from the Committee to proceed with the foreclosures.

Committeeman Zitone made a motion to have Mr. Edelstein & his firm continue with the foreclosures.

Deputy Mayor Barbagallo seconded the motion.

The motion was carried by a unanimous voice vote.

Water Rates

Mr. Edelstein explained that the water rates according to the settlement were to be increased over a period of time as opposed to a large rate increase all at once.

 

Public Participation

Deputy Mayor Barbagallo made a motion to open the meeting to

public participation.

Committeewoman Kaman seconded the motion.

The motion was passed by a unanimous voice vote.

Shakut Ali

Mr. Ali wanted to know is anyone had checked on Mr. Edelstein=s prices to do the foreclosures. Mayor Butto stated his confidence in Mr. Edelstein and his firm to do any and all of the work put before them. Mr. Ali said he only meant that to check is a good practice.

Reginald R. Cole:

Mr. Cole felt that the Township should send letters to the home owners on private roads advising them to make sure the roads are kept open in order for emergency vehicles to get in.

Alice Thon:

Mrs. Thon said that at the January 9, 2001 meeting the problem of the Utility Company came up and everybody agreed something had to be done. The same problem came up again tonight. She asked if anything was being done? Mayor Butto said that a letter had been sent to the Department of Waste Water Management but we have not as yet heard from them.

Mayor Butto asked if anyone else wished to speak. There was no one.

Deputy Mayor Barbagallo made a motion to close public participation.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous voice vote.
