February 27,2001

Minutes

 

Mayor Butto called the session to order at 8:04 p.m. and opened the meeting, stating that the meeting was being held in compliance with the Open Meetings Act, P>L> 1975, c. 231, and has been duly advertised.

The Clerk was asked to call the roll.

Present were: Committeewoman Kaman Committeeman Zitone

Absent: None

All present were asked to join in the Pledge of Allegiance.

Approval of Minutes January 23, 2001 Regular Minutes &

January 23, 2001 Executive Minutes

Committeeman Zitone made a motion to approve the above mentioned minutes with the correction of Ano 6% over $10,000.00.@

Committeewoman Kaman seconded the motion.

The motion was approved by a unanimous voice vote

Resolutions

R01-019 Refund of Overpaid Taxes, Block 5, Lot 65

R01-020 Outside Lien Redemption-Residential Funding Corp.

Certificate #40-97 #41-97

R01-021 Outside Lien Redemption First Union National Bank Collateral Trustee/C.T.M.D. Sass 11

R01-022 Identification of Community Development Block Grant Fair Housing Officer for Montague Township

R01-023 Resolution To Oppose New Waste Water Regulations

Deputy Mayor Barbagallo made a motion to adopt the above mentioned Resolutions.

Committeeman Krebs seconded the motion.

The motion was passed by a unanimous roll call vote:

Nays: None

Mayor Butto made a motion to include under Old Business correspondence from KSM Engineering regarding the re-paving of

New Mashipacong Road and also to include the Special Permit application for the Montague Fire Department.

Deputy Mayor Barbagallo seconded the motion.

The motion was carried by a unanimous voice vote.

Old Business:

Louanne Cular-Emergency Management Deputy (paid)

Jesse Brace-Emergency Management Deputy (volunteer)

Deputy Mayor Barbagallo made a motion to appoint Louanne Cular, Emergency Management Deputy at a salary of $200.00 per year and Jesse Brace, Emergency Management Deputy as a volunteer.

Committeeman Krebs seconded the motion.

The motion was passed by a unanimous roll call vote:

Jack O=Krepky - Resurfacing of New Mashipacong Road

State Aid Project

Mr. O=Krepky advised the Committee, in a letter, that the Township Foreman, David Berhman estimated a $4,800.00 cost of material in addition to the Township DPW labor to repair the twenty-two catch basins on New Mashipacong Road. After a brief discussion, the Committee agreed that this is a necessary expense.

Committeeman Zitone made a motion to approve the expense of $4,800.00 plus labor cost as requested.

Committeewoman Kaman seconded the motion.

The motion passed by a unanimous roll call vote:

New Business

Vernon Township Resolution #01-29

To Retain Sussex County in its Entirety Within The 24th Legislative District

Committeeman Zitone made a motion to support the above referenced Vernon Township Resolution.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous voice vote.

Borough of Sussex Resolution

Resolution urging State Funding To Address Revenue Shortfall Caused by State Inactions on Telecommunications Business Personal Property Tax Reductions

Committeeman Zitone made a motion to support the above mentioned Borough of Sussex Resolution.

Deputy Mayor Barbagallo seconded the motion.

The motion was carried by a unanimous voice vote.

Committeeman Zitone addressed the Committee regarding the very costly and sophisticated in-ground Waste Water permits that are to go into effect March 20th of this year. This applies to anyone doing a sub-division of five (5) or six (6) or more lots. This application fee will be in the neighborhood of $100,000.00 and it will take three (3) years for an approval. This information appeared in the New Jersey Herald.

Committeeman Zitone made a motion for a Resolution opposing this permit, with copies to be sent to the Hon. Robert Littell,

Hon. E. Scott Garrett, The League of Municipalities and all Sussex County Municipalities.

Committeewoman Kaman seconded the motion.

The motion was carried by a unanimous voice vote.

Raffle:

M.A.R.C.H. 50/50

Deputy Mayor Barbagallo made a motion to approve the application of M.A.R.C.H.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous voice vote.

Permits:

Nancy Bender - Blue Light Permit

Patrick J. Kruger - Blue Light Permit

Deputy Mayor Barbagallo made a motion to approve the above mentioned Blue Light Permits.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous roll call vote:

Special Permit-Montague Fire Department

Deputy Mayor Barbagallo made a motion to approve the Special Permit for the Montague Fire Department.

Committeewoman Kaman seconded the motion.

The motion was carried by a unanimous voice vote.

Application for Membership - Richard H. Pond

It was the decision of the Committee to table any action on this application until a future date.

Approval of Vouchers - Payment of Bills:

Deputy Mayor Barbagallo made a motion to approve payment of all vouchers.

Committeeman Krebs seconded the motion.

The motion was passed by a unanimous voice vote.

Correspondence:

County of Sussex - Bike Route

The Committee felt that the subject of a Bike Route thru Montague should be referred to the Land Use Board for their recommendations on this matter.

Letter from Mark Utter:

Mr. Utter sent a letter to the Committee requesting that he be allowed to purchase two (2) lots that were not purchased at the Foreclosure Sale. After a lengthy discussion, it was the decision of the Committee to decline his request and to offer these lots at the next public auction together with all the foreclosed properties owned by the Township.

Public Participation

Deputy Mayor Barbagallo made a motion to open Public Participation.

Committeeman Zitone seconded the motion.

The motion was carried by a unanimous voice vote.

John Ardler

Mr. Ardler suggested that perhaps if ASpeed Bumps@ were installed in the roads it would force the trucks to slow down. The Committee felt that something of that nature would have to be done by the County as Clove and River Roads belong to the County.

Evelyn Mills

Mrs. Mills spoke against the Housing Ordinance as she felt the fees for the inspections of rental properties allowed by this Ordinance are unfair because the State already charges a fee when they inspect rental properties. The Committee disagreed with

Mrs. Mills.

Desmond Finegan

Mr. Finegan wanted to thank the DPW for their assistance in the removal of an appliance from the home of a senior citizen in Montague.

 

Mayor Butto asked if there was anyone else who wished to speak. There was not.

Committeeman Zitone made a motion to close public participation.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous voice vote.

Committeeman Krebs:

Committeeman Krebs requested that the Court Administrator

Ruth Owen be reimbursed for her mileage when she is mandated by the Court system to attend seminars.

Deputy Mayor Barbagallo made a motion to reimburse Mrs. Owen for her mileage.

Committeeman Zitone seconded the motion.

The motion was carried by a unanimous roll call vote:

Deputy Mayor Barbagallo, Committeeman Krebs, Mayor Butto

The motion was seconded by Committeeman Krebs.
