MONTAGUE TOWNSHIP COMMITTEE MEETING

March 27, 2001

Minutes

 

Mayor Butto called the session to order at 8:05 p.m. and opened the meeting, stating that the meeting was being held in compliance with the Open Meetings Act, P>L> 1975, c. 231, and has been duly advertised.

The Clerk was asked to call the roll.

Present were: Committeewoman Kaman, Committeeman Zitone,

Deputy Mayor Barbagallo, Committeeman Krebs

Mayor Butto,

Atty. Murphy, Clerk Felter

Absent: None

All present were asked to join in the Pledge of Allegiance.

Deputy Mayor Barbagallo made a motion to amend the agenda.

Committeeman Zitone seconded the motion.

The motion was passed by a unanimous voice vote.

Approval of Minutes: February 27, 2001

Committeeman Krebs made a motion to approve the minutes of February 27, 2001.

Deputy Mayor Barbagallo seconded the motion.

The Motion was carried by a unanimous voice vote.

Ordinances:

First Reading

Ord. 01-15 Bond Ordinance Providing Appropriation For Improvements To New Mashipacong Road

Committeeman Zitone made a motion to adopt Ord. 01-15.

Committeewoman Kaman seconded the motion.

The motion was carried by a unanimous roll call vote:

Resolutions

R01-25 Transfer of Reserves

Deputy Mayor Barbagallo made a motion to approve R01-25.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous voice vote.

R01-28 Outside Lien Redemption-FUNDCO-Certificates #40-96

R01-30 Outside Lien Redemption-First Union National Bank- Custodian For Breen Capital Group

R01-31 Resolution Opposing New Waste Water Regulations

R01-32 Outside Lien Redemption-Masset-Certificates #45-99

R01-33 Amendment To Capital Budget

R01-34 Resolution to Endorse the 2001 Recycling Tonnage Grant

Committeeman Zitone made a motion to approve the above mentioned Resolutions.

Committeeman Barbagallo seconded the motion.

The motion was approved by a unanimous roll call:

R01-29 Authorization To Hold Accelerated Tax Sale

Committeeman Zitone made a motion to reject R01-29.

Deputy Mayor Barbagallo seconded the motion.

The motion failed on a roll call vote:

Ayes: Committeeman Zitone, Deputy Mayor Barbagallo

Nays: Committeewoman Kaman, Committeeman Krebs, Mayor Butto

A motion to approve R01-29 and to hold the sale on Thursday, December 27, 2001 was made by Committeewoman Kaman.

Committeeman Krebs seconded the motion.

The motion was passed by a roll call vote:

Committeeman Krebs, Mayor Butto

Old Business

Letter From Sussex County Freeholder Director Kuperus

The above mentioned letter referring to truck traffic on

Clove Road requests a meeting with some members of the Montague Committee. Committeeman Zitone advised the Committee that he was disappointed in this request as he felt we should not be meeting with only one of the Freeholders and the Engineers. Committeewoman Kaman said that she felt the entire Committee should be at the meeting and not just a few of the Committee.

She also felt the Freeholders should come to Montague to a public meeting. Committeeman Zitone felt that it would be better to have a couple of our Committee meet with all the Freeholders at a meeting in the County as he didn=t believe all the Freeholders would come to a Special Meeting in Montague. Mayor Butto suggested that we write a letter to Freeholder Director Kuperus asking that at least two of the Freeholders and the County Engineers come to a Special Meeting of our Committee so all the Committee may be present. Committeeman Zitone felt two of our Committee (he would like to be one, as he has worked on this matter for a year or more) should go to the County and meet with the entire Freeholders Board. The Committee requested the Municipal Clerk Helen Felter to write a letter.

 

KSM Engineering - Paving of Municipal Parking Lots

Mr. O=Krepky of KSM advised the Committee in a letter of the cost of paving the Municipal Parking Lots. After a lengthy discussion,

the Committee decided not to take action at this time in order to further study the issue.

Constable-Board of Education

The Committee received a letter from the Board of Education requesting their help in arranging for a Constable to attend the Board of Education meetings. Mayor Butto said he would speak with the Constables to see if there were any objections to accommodating the school=s request.

Foreclosure Sale

Mrs. Jerger spoke with the Committee regarding a minimum bid for the purchase of the foreclosure properties. It was decided to charge a minimum of 10% of the assessed value of the property and that there will be no guarantee of a perk as recommended by

Mr. Ziedeck our Auctioneer.

Committeeman Zitone made a motion to accept the recommendations of Mr. Ziedeck.

Deputy Mayor Barbagallo seconded the motion.

The motion was carried by a unanimous voice vote.

Eric Snyder-Letter Requesting Additional Advertising for Contractors for Small Cities Rehabilitation.

Committeewoman Kaman made a motion to advertise for additional contractors to perform work under the Small Cities Grant.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous voice vote.

New Business

Request Regarding Delivery of Ballots at the Close of Elections to the Board of Elections

Mayor Butto advised the Committee that he would take up the above mentioned matter with Constable Benson after the meeting in order to accommodate this request.

Spring Clean Up

The Committee requested Clerk Felter to bring the information from last year=s Clean Up to the next meeting and then they will decide on when it is to be held etc.

Approval of Vouchers - Payment of Bills:

Committeeman Zitone made a motion to approve all the vouchers.

Deputy Mayor Barbagallo seconded the motion.

The motion was carried by a unanimous voice vote.

Correspondence:

Tri-State Chamber of Commerce-7th Annual Tri-State Fall Foliage 10K Classic

Committeeman Zitone made a motion to allow the Tri-State Chamber to use certain Montague Roads for their annual Tri-State Chamber of Commerce 10K Classic.

Deputy Mayor Barbagallo seconded the motion.

The motion was approved by a unanimous voice vote.

Sussex County League of Municipalities Meeting- Wastewater Management

There will be a meeting Wednesday, April 11, 2001 at the Lafayette House regarding Wastewater Management. Deputy Mayor Barbagallo and Committeeman Zitone were going to try to attend.

Public Participation

Deputy Mayor Barbagallo made a motion to open the meeting to

public participation.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous voice vote.

Reginald Cole

Mr. Cole was concerned about the liability of the Township with regard to one of the Constables attending the School Board Meeting. Mr. Edelstein, attorney for the Township, advised

Mr. Cole that the Township is properly insured if such a need was to arise.

Mr. Cole also stated that Clove Road does not meet Federal standards. Mayor Butto told Mr. Cole that Clove Road is a County Road, not ours. However, there are improvements to this Road scheduled to start in October of this year.

Committeewoman Kaman made a motion to adjourn the meeting.

Deputy Mayor Barbagallo seconded the motion.

The motion was carried by a unanimous voice vote.
