MONTAGUE TOWNSHIP COMMITTEE MEETING

April 10, 2001

Minutes

Mayor Butto called the session to order at 8:10 p.m. and opened the meeting, stating that the meeting was being held in compliance with the Open Meetings Act, P>L> 1975, c. 231, and has been duly advertised.

The Clerk was asked to call the roll.

Present were: Committeewoman Kaman, Committeeman Zitone,

Deputy Mayor Barbagallo, Committeeman Krebs

Mayor Butto,

Atty. Murphy, Clerk Felter

Absent: None

All present were asked to join in the Pledge of Allegiance.

Approval of Minutes: March 13, 2001

Committeeman Zitone made a motion to approve the minutes of

March 13, 2001.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous roll call vote:

Ayes: Committeewoman Kaman, Committeeman Zitone,

Committeeman Barbagallo, Committeeman Krebs, Mayor Butto

Nays: None

Bids For Re-paving Of New Mashipacong Road:

Clerk Felter opened the bids and Mayor Butto read the bid amounts out loud, in public.

Intercounty Paving Associates, LLC: $144,935.00

Owl Contracting: $131,131.00

Schifano Construction Corp.: $133,845.00

Mt. Hope Rock Products, Inc.: $197,397.60

Lakeside Construction: $158,606.00

Tilcon New York, Inc.: $119,373.00

Deputy Mayor Barbagallo made a motion the Bid Packages be given to our Attorney for inspection and then to our Engineer.

Committeeman Krebs seconded the motion.

The motion was carried by a roll call vote:

Ayes: Committeewoman Kaman, Committeeman Zitone,

Deputy Mayor Barbagallo, Committeeman Krebs, Mayor Butto

Nays: None

Appointments:

Assessor David Poe

Committeeman Barbagallo made a motion to appoint David Poe as

Township Assessor for the remainder of the term vacated by

Ben Murdoch.

Committeewoman Kaman seconded the motion.

The motion was passed by a roll call vote:

Deputy Mayor Barbagallo, Committeeman Krebs, Mayor Butto

Recreation Commission

The matter of appointments to the Recreation Commission was tabled to a later date.

Second Reading

Ord. 2001-014 An Ordinance to Address Underage Drinking

Committeeman Zitone made a motion to open the Public Hearing.

Deputy Mayor Barbagallo seconded the motion.

The motion was carried by a unanimous voice vote:

Public Hearing:

Desmond Finegan

Mr. Finegan asked who would be enforcing this Ordinance.

Mayor Butto replied it would be the jurisdiction of the

State Troopers and the Sheriff=s Department.

There were no additional comments.

Committeeman Zitone made a motion to close Public Participation.

Deputy Mayor Barbagallo seconded the motion.

The motion was carried by a unanimous voice vote.

Committeeman Zitone made a motion to adopt Ord. 2001-014 on second reading.

Deputy Mayor Barbagallo seconded the motion.

The motion was carried by a unanimous roll call:

Ord. 2001-015 Bond Ordinance for Resurfacing New Mashipacong Rd.

Committeeman Zitone made a motion to open Public Participation.

Committeewoman Kaman seconded the motion.

The motion was carried by a unanimous voice vote.

Public Hearing:

There was no comment.

Deputy Mayor Barbagallo made a motion to close the Public Hearing.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous voice vote.

Committeeman Zitone made a motion to adopt Ord.2001-015 on second reading.

Committeewoman Kaman seconded the motion.

The motion was carried by a unanimous roll call vote:

Resolutions:

R2001-035 Outside Lien Redemptions

Committeeman Zitone made a motion to adopt R2001-035.

Deputy Mayor Barbagallo seconded the motion.

The motion was carried by a unanimous roll call vote:

Deputy Mayor Barbagallo, Committeeman Krebs, Mayor Butto

Old Business

Spring Clean-up

After a short discussion, the Township Committee decided to have the annual Spring Clean-up the weekend of May 19th & 20th

The terms of the Clean -up will be the same as last year. The Committee directed the Clerk to advertise for bidders.

Committeeman Zitone made a motion to adopt the above policy.

Committeewoman Kaman seconded the motion.

The motion was carried by a unanimous voice vote.

Township of Green Resolution - Addressing Property Taxes in

New Jersey

Committeeman Zitone made a motion to support the

Township of Green Resolution calling for Property Tax reform.

Deputy Mayor Barbagallo seconded the motion.

The motion was passed by a roll call vote:

Ayes: Committeeman Zitone, Deputy Mayor Barbagallo,

Committeeman Krebs, Mayor Butto

Nays: Committeewoman Kaman

Reports

Committeewoman Kaman felt all Departments should submit a monthly report to the Committee. She offered to locate forms to be used for this purpose.

New Business

Funding for the DPW Dump Truck and Pick-up Truck

It was decided by the Committee to table discussion on this matter until the next meeting.

Deputy Mayor Barbagallo made a motion to table the above item until the next meeting.

Committeeman Zitone seconded the motion.

The motion was carried by a unanimous voice vote.

Grants

Committeeman Krebs suggested the Committee should consider having a Grant Company check into additional grants for the Township.

Foreclosure Sale

The Foreclosure Sale is scheduled for May 4th., at 7:00 p.m. at the Municipal Building. This information will also be placed on our Web Site. Mrs. Jerger, Tac Collector for the Township gave a listing of what properties are up for sale to the Committee.

Approval of Vouchers - Payment of Bills:

Committeeman Zitone made a motion to approve the bills for payment.

Deputy Mayor Barbagallo seconded the motion.

The motion was approved by a unanimous voice vote.

Correspondence:

Rock & Road Cycling Club

Deputy Mayor Barbagallo made a motion to allow the Rock & Road Cycle Club to hold their annual race.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous voice vote.

CFO Spring Conference

Mrs. Jerger requested permission of the Committee to attend

the CFO=S Spring Conference.

Deputy Mayor Barbagallo made a motion to approve Mrs. Jerger=s request.

Committeeman Zitone seconded the motion.

The motion was passed by a unanimous voice vote.

Public Participation

Deputy Mayor Barbagallo made a motion to open the floor to Public Participation.

Committeeman Krebs seconded the motion.

The motion was approved by a unanimous voice vote.

Desmond Finegan

Mr. Finegan advised the Committee that he had received an acknowledgment from Mr. Snyder, the Township Grant Writer, regarding a potential grant paper he had sent to him.

Mr. Finegan also asked the Committee to continue doing everything in their power to correct the problems on Clove Road. He said

AWhat is a child=s life worth?@

Reginald Cole

Mr. Cole congratulated the Committee on passing the Ordinance dealing with underage drinking. He said he has been in the front of the Municipal Building and found broken beer bottles in the grass. He said he felt the grounds should be posted with

ANo Alcohol Allowed@ signs.

Richard Pond

Mr. Pond asked the Committee what action had been taken regarding his application for membership in the Montague Fire Department.

Mr. Pond was told that action on his application had been tabled.

Richard Clauberg

Mr. Clauberg addressed the Committee with several suggestions that might help the very dangerous conditions on Clove Road.

Mayor Butto made notes and suggested to Mr. Clauberg that, because Clove Road is a County Road, he might want to take his suggestions to the Board of Chosen Freeholders.

Keith Utter

Mr. Utter, whose son Jamie was one of the fatalities on Clove Road, spoke to the Committee regarding what could be done about Clove Road. He has spoken with the County people and found out that repairs to Clove Road are the third priority of the County.

He asked why, with the history of death on this road, is it third? The Committee agreed with Mr. Utter.

Mayor Butto asked if there was anyone else who wished to speak?

There was not.

Committeeman Zitone made a motion to close Public Participation.

Deputy Mayor Barbagallo seconded the motion.

The motion was carried by a unanimous voice vote.
