August 14, 2001

Minutes

 

Mayor Butto called the session to order at 8:05 p.m. and opened the meeting, stating that the meeting was being held in compliance with the Open Meetings Act, P>L> 1975, c. 231, and has been duly advertised.

The Clerk was asked to call the roll.

Present were: Committeewoman Kaman, Committeeman Zitone,

Committeeman Barbagallo, Committeeman Krebs, Mayor Butto

Clerk Felter, Denis Murphy, Esq.

Absent: None

All present were asked to join in the Pledge of Allegiance.

Approval of Minutes: June 12, 2001 Regular Meeting

Committeeman Krebs made a motion to approve the above mentioned minutes.

Committeeman Zitone seconded the motion.

The motion was passed by a unanimous roll call vote:

Carl Sokolick

Deputy Mayor Barbagallo made a motion to appoint Carl Sokolick to the Advisory Board of Health.

R01-062 Authorization to Apply for a Smart Growth Planning Grant

Deputy Mayor Barbagallo made a motion to adopt R01-062.

Old Business

Housing Rehabilitation Program-Eric Snyder

Committeewoman Kaman made a motion to do a mailing of a flyer to the residents of the Township of Montague explaining the guide lines for a Small Cities grant.

Committeeman Krebs seconded the motion.

Draft Housing Element and Fair Share Plan - Eric Snyder

The Committee acknowledged receipt of copies of the Draft Housing Element and Fair Share Plan and will await action from the

Land Use Board before taking further action.

Fire Prevention Fee Schedules for Comparison

Committeeman Zitone made a motion to table any action on the above matter.

Deputy Mayor Barbagallo seconded the motion.

Mr. Murphy gave an up- date concerning the status of the above mentioned litigation. A copy of the Trial Brief was given to the Committee.

New Business

Morris County Co-op - Dave Berhman, Foreman DPW

Mr. Berhman made a request for permission to join the Morris County Co-op.

Deputy Mayor Barbagallo made a motion to join the Morris County Co-op.

Committeeman Krebs seconded the motion.

Request to Buy Foreclosed Property

The Committee received a request from Michael Romaniak of Montague, New Jersey to purchase Block 19, Lot 45.08 for the minimum bid of $1,300.00. After discussing this matter, it was the decision of the Committee to table further action on this matter.

Deputy Mayor Barbagallo made a motion to table any action on the above mentioned matter.

Committeewoman Kaman seconded the motion.

911 Co-ordinator

After a lengthy discussion as to who has what duties in the area of assigning street numbers and making sure the maps are available and up to date, Mayor Butto said he would call all involved parties and have a meeting to straighten it out.

Return of Property - Karl Ardler

Mr. Ardler wrote a letter to the Committee stating his wish to return to the Township a piece of property he had previously purchased.

Committeewoman Kaman made a motion to accept the return of the property.

Deputy Mayor Barbagallo seconded the motion.

CFO

It was the decision of the Committee to start a search for a CFO to replace Mrs. Jerger who plans to retire in January, 2002.

Committeewoman Kaman made a motion to place advertisements in the newspapers etc., advertising for a CFO as of January 2002.

Committeeman Krebs seconded the motion.

New Myrtle Drive/Ridge Road

Committeeman Zitone explained to the Committee that every time there is a heavy rain there is a tremendous wash out on the

Red Hill end of New Myrtle Drive/Ridge Road. A lengthy discussion followed. Deputy Mayor Barbagallo suggested the Committee have the Township Engineer do a study to ascertain the cost of the engineering necessary to bring this road up to Township standards, to be paid by the Township, and if necessary take the road under eminent domain and the residents on the road will have to pay a road assessment.

Deputy Mayor Barbagallo made a motion to proceed with the engineering of New Myrtle Road.

Committeeman Zitone seconded the motion.

Reports: Committeeman Mark Krebs

Caddoo Road - Committeeman Krebs advised the Committee that the Park Service has placed picnic tables and benches at the end of Caddoo Road as requested.

Extra Court Date - Committeeman Krebs said that Mrs. Owen the Court Administrator feels that an extra court date in September or October may be necessary.

Energy Study - Committeeman Krebs also asked the Committee=s permission to have the power company do an energy study in the Municipal Building. The Committee agreed to have this done.

Deputy Mayor Barbagallo advised the Committee that the sign dedicating the Route 206 ballfield to Nick Merusi and

Adam Youngman was completed and has been put up.

Deputy Mayor Barbagallo also suggested that a resolution

be passed formerly dedicating the field in the name of the two boys.

Deputy Mayor Barbagallo made a motion to authorize payment of the outstanding balance due for the above mentioned sign.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous voice vote.

Approval of Vouchers - Payment of Bills:

Committeeman Krebs made a motion to pay the bills with corrections concerning the two Smart Grant money vouchers.

Committeewoman Kaman seconded the motion.

The motion was carried by a roll call vote:

Committeewoman Kaman made a motion to send a letter to the water company asking for certification of the fire hydrants.

Committeeman Krebs seconded the motion.

Correspondence:

Aggregation of Cable Service-E. Scott Garret

The Committee acknowledged receipt of Assemblyman Garret=s letter

and requested a letter be sent in reply thanking him for including Montague however, we are not in an area that would be

affected by this aggregation of cable services.

Public Participation

Deputy Mayor Barbagallo made a motion to open the meeting to public participation.

Committeewoman Kaman seconded the motion.

The motion was carried by a unanimous voice vote.

Diana Weiner:

Mrs. Weiner thanked the Committee for the great job they are doing. She also spoke to them regarding a problem with finishing the house that she and Dr. Weiner are building to replace the one that burned down. The Committee agreed to look into it.

Desmond Finegan:

Mr. Finegan explained to the Committee that he had sent a letter to a public official as the Montague Senior Advocate and had not yet received an answer after two (2) months. He felt this to be an insult to himself and the Township.

Reginald Cole:

Mr. Cole stated that he felt that 911 was not up-to-date. The houses are not properly marked and the Ordinance is not enforced.

Mr. Cole went on to say he felt the Small Cities Grant should be made available to the entire Township not just a Atarget area.@

Michael Ioele:

Mr. Ioele questioned the correct name of New Myrtle Drive.

Is the name New Myrtle Drive, Myrtle Drive or Ridge Road?

Mr. Ioele was told the Township would look into it.

Dominick Ioele:

Mr. Dominick Ioele addressed the Committee and stated that

New Myrtle Drive was deeded to the Township. Mayor Butto explained to Mr. Ioele that any road can be deeded to the Township, however, if it is not accepted by ordinance it is not a Township Road.

Genevieve Thompson:

Ms. Thompson asked the Committee if the residents will be involved in the assessment process. Committeeman Zitone explained that there would have to be a study done by the Township Engineer and then there will be a meeting with the residents.

Henry Zeeuw

Mr. Zeeuw thanked the Committee for their attention concerning the matter of the fence that was constructed by Mr. Conti between their properties. Mr. Zeeuw went on to say it is an ugly structure and he would like to see the Township remove it if possible.

Alfred Gorlach

Mr. Gorlach again addressed the Committee regarding the problems on Hidden Hollow Way. He told the Committee that not only are there parties going on, now there is garbage being dumped.

After a short discussion, the Committee said they will look into closing off the road passed Mr. Gorlach=s house as a possible solution and they will also ask the DPW to pick up the trash.

Mr. Gorlach thanked the Committee for their concern.

Richard Clauberg

Mr. Clauberg asked the Committee if we have heard anything from the County regarding repairs to Clove Road. Mayor Butto read from a letter the Township had received outlying the repairs they are in the process of implementing. Mr. Clauberg requested a copy of the letter and he was referred to the Clerk=s office.

Mayor Butto asked if anyone else wished to speak. There was no one.

Committeeman Zitone made a motion to close public participation.

The motion was carried by a unanimous voice vote.
