MONTAGUE TOWNSHIP COMMITTEE MEETING

October 28, 2003



Minutes





Mayor Barbagallo called the session to order at 8:12 p.m. and opened the meeting, stating that the meeting was being held in compliance with the Open Meetings Act, P>L> 1975, c. 231, and has been duly advertised.



The Clerk was asked to call the roll.



Present were: Committeewoman Kaman, Deputy Mayor Zitone Committeeman Butto, Committeeman Krebs,

Mayor Barbagallo

Helen F. Felter, Clerk, Denis G. Murphy, Atty.

Absent: None



All present were asked to join in the Pledge of Allegiance.

Ordinances:

Second Reading:

Ord. 2003-22 An Ordinance to Amend Chapter 76 of the General Ordinance of the Township of Montague, Being the Zoning Chapter

for the purpose of amending Ordinance 2003-08 Removing the Three Acre Minimum Lot Sizes in the R-4 Zone High Density Residential Zone District Within the Township



Committeeman Krebs made a motion to adopt Ord. 2003-22

Committeeman Butto seconded the motion.



Committeeman Krebs made a motion to open the public hearing.

Committeeman Butto seconded the motion.



Public Hearing:

No public comment



The motion to approve Ord. 2003-22 was approved by a unanimous

roll call vote:

Ayes: Committeewoman Kaman, Deputy Mayor Zitone,

Committeeman Butto, Committeeman Krebs, Mayor Barbagallo

Nays: None



Resolutions

R2003-86 Refund of Previous Years Taxes Due to Tax Court Judgement - Block 8, Lot 6

R2003-87A Construction in the Armstrong Tract

Committeeman Krebs made a motion to approve the above mentioned resolutions.

Deputy Mayor Zitone seconded the motion.

The motion was carried by a unanimous voice vote.







Old Business

Cell Tower

Denis Murphy, attorney for the Township, explained to the Committee that it is the intention of Crown Towers to proceed with the building of the cell tower. The Committee asked

Mr. Murphy to write to the cell tower company and explain that the time has come for them to start paying rent to the Township.



Tax Abatement

The Committee asked the Clerk to put the tax abatement issue on the next agenda in the form of an ordinance.



New Business

Board of Health Meeting

Committeeman Krebs advised the Committee that the next Board of Health meeting is scheduled for the same day as elections. The Committee decided to cancel the meeting for November.

Committeeman Krebs made a motion to cancel the meeting.

Deputy Mayor Zitone seconded the motion.

The motion was carried by a unanimous roll call vote:

Ayes: Committeewoman Kaman, Deputy Mayor Zitone,

Committeeman Butto, Committeeman Krebs, Mayor Barbagallo

Nays: None



Fran Multari, Tax Collector-Donated Property, Kleinman, Block 8,

Lot 48

Mrs. Multari requested direction from the Committee concerning their wishes regarding the outstanding taxes due on block8,

lot 48. After a short discussion, the Committee decided to ask the Tax Collector to write a letter requesting payment of the taxes.

Deputy Mayor Zitone made a motion that an attempt be made to collect the outstanding taxes so the Township may accept the property unencumbered.

Committeewoman Kaman seconded the motion.

The motion was carried by a unanimous voice vote.



LeRoy F. Kleso and Antoinette M. Kleso, Subordination of Mortgage

Mr. & Mrs. Kleso requested the Committee to allow the subordination of their Small Cities grant mortgage. The committee agreed to allow it.

Committeewoman Kaman made a motion to allow the subordination of the mortgage.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous voice vote.



David Berhman-Snow Plowing

David Berhman, Foreman of Montague Dept. of Public Works requested permission to hire two (2) part time snow plowers.

After a short discussion, the Committee decided to table any action in this matter until their next regularly scheduled meeting.



State Road Grant

After a lengthy discussion regarding which qualifying road to apply to the State for a grant the Committee decided the road that needed the work most was Weider Road. Mayor Barbagallo will contact the Township engineer.



Fire Truck

The Montague Volunteer Fire Department donated their fire truck

R685F 1072 to the Township.

Committeeman Krebs made a motion to accept the donation of the fire truck.

Committeeman Butto seconded the motion.

The motion was carried by a unanimous voice vote.



Approval of Vouchers - Payment of Bills:

No vouchers paid at the second meetings of the month



Correspondence:

Township Meetings:

It was the decision of the Township Committee to cancel both of the November meetings and hold a meeting on the 18th of November.

at 8:00p.m.

Committeeman Butto made a motion to cancel both meetings in November and schedule a meeting at 8pm on November 18th.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous voice vote.



Request to Refund Permit Overcharge

Deputy Mayor Zitone made a motion to refund the permit overcharge.

Committeeman Butto seconded the motion.

The motion was carried by a unanimous voice vote.



Public Participation

Committeewoman Kaman made a motion to open the public participation.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous voice vote.



Dominic Iole

Mr. Iole asked the Committee who owns New Myrtle Drive. He said he would like to know if he lives on a private road or a

township road. Mayor Barbagallo explained that we are in the process of finding that information out.



Reginald Cole

Mr. Cole spoke to the Committee concerning the property known as

Block 48, Lot 44. Mr. Cole said he would like to see this property which was known as "Roberts" put up for sale if it is actually "unknown." Mayor Barbagallo explained to Mr. Cole that the Township is having a title search done on this property and nothing will be done until the search is completed.



Debra Mulligan

Mrs. Mulligan asked the Committed to consider an outside announcement sign so the residents of Montague will know what's

scheduled in the Township. Mayor Barbagallo advised

Mrs. Mulligan that this matter was presently being looked into.



Evelyn Mills

Mrs. Mills spoke to the Committee regarding a discrepancy

in the amount of acreage of a piece of property. The Committee advised her to check the deed and speak to the Assessor.

Mrs. Mills also voice a negative opinion regarding the construction of a storage business being built within the designated Town Center. It was explained to her that the finished product will be landscaped and have buffer zones.



Mark Sternfill

Mr. Sternfill spoke to the Committee regarding vandalism on

Galloping Hill Road. A person or persons painted on the road and also on the road signs. Mayor Barbagallo told Mr. Sternfill that he would have our DPW Foreman look into the matter. Mr. Sternfill also mentioned that the storm drains have not been maintained and that the water is backing up. Mayor Barbagallo said he would ask Mr. Berhman to look into that problem also.



Mayor Barbagallo asked if anyone else wished to speak. There was no one.



Committeeman Butto made a motion to close public participation.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous voice vote.
