MONTAGUE TOWNSHIP COMMITTEE MEETING
September 9, 2003
Minutes
Mayor Barbagallo called the session to order at 8:00 p.m. and opened the meeting, stating that the meeting was being held in compliance with the Open Meetings Act, P>L> 1975, c. 231, and has been duly advertised.
The Clerk was asked to call the roll.
Present were: Committeewoman Kaman, Deputy Mayor Zitone Committeeman Butto, Committeeman Krebs,
Mayor Barbagallo
Helen F. Felter, Clerk, Denis G. Murphy, Atty.
Absent: None
All present were asked to join in the Pledge of Allegiance.
Approval of Minutes: Corrected Minutes of 6-10-03
Minutes of 8-12,2003
Committeeman Butto made a motion to approve the corrected minutes of the Regular Session of June 10,2003 and the Regular Session of August 12, 2003.
Committeeman Krebs seconded the motion.
The motion was carried by a unanimous voice vote.
Ordinances:
First Reading:
Ord. 2003-21 An Ordinance to Establish an R4SC Zone
Deputy Mayor Zitone made a motion to adopt Ord. 2003-21.
Committeeman Krebs seconded the motion.
The motion to approve Ord. 2003-21 was approved by a unanimous
roll call vote:
Ayes: Committeewoman Kaman, Deputy Mayor Zitone,
Committeeman Butto, Committeeman Krebs, Mayor Barbagallo
Nays: None
Resolutions
R2003-77 Authorization to Apply for a Grant from the Department of Community Affairs
R2003-78 Cancellation of Taxes on Erroneous Assessment
R2003-79 Refund of Overpayment of Taxes
R2003-80 Outside Lien Redemptions
R2003-81 Authorizing Cancellation of Township Certificates
R2003-82 General Comments & Recommendations-2002 Audit
R2003-83 Refund of Developers Escrow Deposit
Committeeman Butto made a motion to approve all of the above mentioned resolutions.
Committeeman Krebs seconded the motion.
The motion was carried by a unanimous voice vote.
Old Business
Corrective Action Plan-2002 Annual Audit
Committeeman Butto made a motion to accept the 2002 Annual Audit Corrective Action Plan.
Committeeman Krebs seconded the motion.
The motion was carried by a unanimous voice vote.
New Business
None
Reports:
Tax Collector's Reports of Revenue Collected- July & August
Montague Volunteer Fire Department Monthly Reports- July & August
The Committee acknowledged receipt of the above referenced reports.
Approval of Vouchers - Payment of Bills:
There was one addition to the bill list for payment of a prisoners bench.
Committeeman Krebs made a motion to approve the bill list with the addition.
Committeeman Butto seconded the motion.
The motion was carried by a unanimous voice vote.
Correspondence:
Donna Marie Zito-Request to Use Library
The Committee read Ms. Zito's request to use the Library in the lower level of the Township Municipal Building, however, as in the past, the Committee had to refuse the request as there is currently no policy allowing the use of any of the areas in the Municipal Building by any outside organizations.
Cellco Partnerships:
Denis Murphy, attorney for the Township advised the Committee that he has not gotten any response from Cellco Partnership or their attorney, Gregg Czura regarding the building of the cell tower on the property behind the Municipal Building. After a lengthy discussion, the Committee asked Mr. Murphy to write another letter to set a final date for a response or they will have to take further action.
Public Participation
Committeewoman Kaman made a motion to open the meeting to public participation.
Committeeman Krebs seconded the motion.
The motion was approved by a unanimous voice vote.
Patricia Duran
Ms. Duran has a problem with the assessment on her home property. It was raised this year with no explanation and she has not done any renovations. Ms. Duran said she spoke to Mr. Poe the Township Assessor and he told her it was a computer error.
Committeewoman Kaman told her to have Mr. Poe call her.
Ms. Duran thanked the Committee for their help.
Mayor Barbagallo asked if there was anyone else who wished to speak. There was no one.
Deputy Mayor Zitone made a motion to close the public participation.
Committeeman Krebs seconded the motion.
The motion was carried by a unanimous voice vote.

The meeting closed at 8:50 p.m.
