MONTAGUE TOWNSHIP COMMITTEE MEETING

FEBRUARY 13, 2007

Minutes

Regular Session begins at 8:00p.m. unless otherwise noted.

Mayor Utter called the meeting to order. Those present were: Mr. Brislin, Mr. Lashendock, Mr. Barbagallo, Mr. Brace, Mr. Utter, Attorney Hinkes and Clerk Francisco.

EXECUTIVE SESSION including employee health benefits, and potential litigation.

WHEREAS, the Township Committee of the Township of Montague, County of Sussex, State of New Jersey finds it necessary to discuss matters relating to possible litigation, and employee health benefits; and

WHEREAS, the Township Committee believes it to be in the best interest of the public to discuss such matters in closed session.

NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Montague County of Sussex ,State of New Jersey that it shall enter closed session to discuss only the matters mentioned above; the result of which may be made public immediately thereafter or at a later date.

Mr. Lashendock motioned to enter into executive session. Mr. Barbagallo seconded the motion.

The motion was carried with all in favor.

With no other items to discuss in Executive Session, the Executive session was closed on motion of Mr. Brislin seconded by Mr. Lashendock. The motion was carried with all members in favor.

Mayor Utter stated the meeting was being held in Compliance with the Open Public Meetings Act P.L.1975, C. 231 and has been duly advertised.

All present were asked to join in the Pledge of Allegiance.

PUBLIC PARTICIPATION REGARDING AGENDA ITEMS

Mr. Brislin motioned to amend the agenda by adding a resolution (Health Benefits)

Mr. Brace seconded the motion. The motion was carried with all in favor.

Mr. Brislin motioned to open to the public regarding agenda items only. Mr. Lashendock seconded the motion. The motion was carried with all in favor. There was no comment from the public.

Mr. Brace motioned to close to the public regarding agenda items. Mr.Lashendock seconded the motion. The motion was carried with all in favor.

MINUTES

Mr. Brislin motioned to adopt the minutes of the executive session minutes of January 23, 2007. Mr. Brace seconded the motion. The motion was carried with a unanimous roll call vote.

Mr. Lashendock motioned to approve the minutes of regular sessions of January 16, 2007 and January 23, 2007. The motion was carried with all in favor.

COMMITTEE REPORTS

Administration- Mr. Utter and Mr. Brislin attended a shared services meeting with Frankford Township. Mr. Utter will recommend the Township send a letter of interest to Frankford regarding Court Services Township

RESOLUTIONS

R 2007-15 OUTSIDE LIEN REDEMPTION

Mr. Barbagallo motioned to adopt the above-mentioned resolution. Mr. Brislin seconded the motion. The motion was carried by a unanimous roll call vote.

R 2007-16 REMOVAL OF TAXES ON EXEMPT PROPERTY

Mr. Lashendock motioned to adopt the above referenced resolution. Mr. Brislin seconded the motion. The motion was carried by a unanimous roll call vote.

R 2007-17 AMENDMENT OF PERSONNEL MANUAL

Mr. Brislin motioned to adopt the above-mentioned resolution. Mr. Brace seconded the motion. The motion was carried by a roll call vote. Vote-Mr. Brislin yes, Mr. Lashendock, yes, Mr. Barbagallo no, Mr. Brace yes, Mr. Utter yes.

ORDINANCES (second reading)

ORD 2007-001 AN ORDINANCE TO AMEND THE TOWNSHIP LAND USE CODE REGARDING OFF TRACT IMPROVEMENTS NECESSITATED BY CERTAIN DEVELOPMENT PROJECTS .

Mr. Brislin motioned to adopt the above referenced ordinance on second reading. Mr. Lashendock seconded the motion. The motion was carried with a unanimous roll call vote.

Mr. Brace motioned to open to the public for comment. Mr. Brislin seconded the motion. The motion was carried with all in favor. There was comment from the public.

Mr. Lashendock motioned to close to the public. The motion was seconded by Mr. Brislin. The motion was carried with all in favor.
