MINUTES OF MONTAGUE TOWNSHIP COMMITTEE MEETING
August 14, 2007

 Mayor Utter called the meeting to order and stated that the meeting was being held in compliance with Open Public Meetings Act P.L. 1975 C. 231and has been duly advertised.

All present were asked to salute the flag.

Those present were Mr. Brislin, Mr. Lashendock, Mr. Barbagallo, Mr. Brace, Mr. Utter, Attorney Hinkes and Clerk Francisco.

Mr. Brislin motioned to go into executive session to discuss personnel matters and  matters in litigation. Mr. Brace seconded the motion .  The motion was carried with all in favor. 

     WHEREAS, the Township of Montague, County of Sussex, State of New Jersey, finds it necessary to  discuss matters relating to personnel and litigation and,

      WHEREAS, the Township Committee of the Township of Montague believes it to be in the best interest of the public to discuss only those matters in closed session.

      NOW, THEREFORE  BE IT RESOLVED by the Township Committee of the Township of Montague, County of Sussex, State of New Jersey, that it shall enter into closed session to discuss only matters mentioned above, the result of which may be made public immediately thereafter or at a later date.

The Township Committee returned from executive session and the meeting resumed.

PUBLIC PARTICIPATION REGARDING AGENDA ITEMS

Mr. Lashendock motioned to open to the public for agenda items only.  Mr. Brislin seconded the motion.  The motion was carried with all in favor.  There was no public comment. MR. Barbagallo motioned to close to the public.  Mr. Brace seconded the motion.  The motion was carried with all in favor.

MINUTES- Regular Session July 24, 2007

Mr.  Lashendock motioned to approve the minutes of July 24, 2007.  Mr. Brislin seconded the motion. The motion was carried with all in favor.

COMMITTEE REPORTS
Administration, Finance, Health and Welfare, Public Works, Public Safety and Recreation.  No action was taken.

RESOLUTIONS

Mr. Lashendock motioned to adopt all the above-mentioned resolutions.  Mr. Brislin seconded the motion.  The motion was carried by a unanimous roll call vote.

ORDINANCES (First Reading)

Ord 2007-008     ORDINANCE TO AMEND THE ADMINISTRATIVE CODE SECT 2-20              
Mr. Brislin motioned to adopt Ordinance 2007-008 on first reading  Mr. Brace seconded the motion.  The motion was carried by a majority roll call vote.  Mr. Brislin, yes;  Mr. Lashendock, yes;  Mr. Barbagallo, no; Mr. Brace, yes;  Mr. Utter, yes.

BILLS LIST    Payment of Vouchers

Mr. Barbagallo motioned to pay the bills.  Mr. Lashendock seconded the motion.  The motion was carried by a unanimous roll call vote.

CONSENT AGENDA

Application for Fire Department Membership-Alan Berkenbush, Application for First Responder-Carrie Ellicott, Blue Light Permit Applications Carrie Ellicott and Martin Ellicott

Mr. Barbagallo motioned to approve the above applications. Mr. Lashendock seconded the motion.  The motion was carried by a unanimous roll call vote.

NEW BUSINESS

School Board Request for Bus Stop Signs
Mr. Lashendock motioned to have the DPW install 11 bus stop signs for the Montague Board of Education.  Mr. Brislin seconded the motion.  The motion was carried by a unanimous roll call vote.

CCHP Proposed Housing Inspection Requirements
Mr.  Brislin motioned to amend the Housing Inspection Ordinance to include:  1. Annual Inspection of Common areas of multi family dwellings and 2. Inspection upon sale of all multiple family dwellings. Also in the motion was to solicit suggestions from the Community Corporation of High Point Board of Trustees regarding the amendments, forwarding same to the Housing Inspector and if they were in favor, then giving the amendment ideas to the township attorney for completion.

Mr. Brace seconded the motion.  The motion was carried by a unanimous roll call vote.

An addendum to Inter Local Service Agreement- for Construction of An Athletic Field-addendum to the previous agreement with the Board of Education which includes an additional $9000.00 and completion date of June 30, 2008.

Mr. Brislin motioned to approve the addendum to the Interlocal Service Agreement for the construction of the Athletic Field. Mr. Lashendock seconded the motion.  The motion was carried by a unanimous roll call vote.

Beerskill Road Retaining Wall Footing Erosion
Mr.  Barbagallo motioned to proceed with an estimate submitted by the township engineer and clarify if engineering costs of $9,120.00 includes the preparation of a bid package. Mr. Lashendock seconded the motion.  The motion was carried by a unanimous roll call vote.

Corrective Action Plan for the 2006 Audit
Mr. Brace motioned to accept the Corrective action plan as submitted by the CFO.  Mr. Brislin seconded the motion.  The motion was carried by a unanimous voice vote. 

Mr. Brislin motioned to have the Clerk or the CFO have price quotes updated for Fixed Asset Appraisals based on amounts of $100 and $500.   Mr. Brace seconded the motion.  The motion was carried by a unanimous voice vote.

UNFINISHED BUSINESS

9-1-1 PSAP Consolidation Project
Mr. Brace motioned to accept the 9-1-1 PSAP Report as submitted.  Mr. Brislin seconded the motion.  The motion was carried by a voice vote.  Mr. Barbagallo abstained.

Census
Mr. Barbagallo motioned to table discussion.  Mr. Lashendock seconded the motion.  The motion was carried with all in favor.

2007 League of Municipalities Conference ( Atlantic City)
Mr. Brislin motioned to review requests for Conference at Executive Session at next meeting.  Mr. Brace seconded the motion.  The motion was carried with all in favor.

Speed Study Related to Myrtle Drive
KSM submitted a price quote of $3,500.00.

Mr. Brislin motioned to solicit other price quotes for traffic study.  Mr. Lashendock seconded the motion.  The motion was carried with all in favor.

Land Transfer Proposal: Blk 19, Lot 45.01, 134 Deckertown Tpk-
Attorney Hinkes updated the committee on the offer to convey the above property to the town.  Mr. Hinkes suggested letting the property to go to tax foreclosure unless the owner can convey clear title.  Mr. Brislin motioned to have the attorney respond.  Mr. Lashendock seconded the motion.  The motion was carried with all in favor. 

Transoption Grant
Mr. Brislin motioned to authorize grants person to move forward to next step, to obtain funding to implement plan.  Mr. Brace seconded the motion.  The motion was carried with all in favor.

REPORTS

Tax Collector Report for July 2007

Lashendock motioned to accept the report as submitted.

Taxes collected $1,141,475.98 for the month of July and year  to date $4,948,958.48.  Mr. Brislin seconded the motion.  The motion was carried with all in favor.

CORRESPONDENCE

Protecting New Jersey -Preparing for Catastrophe- Mr. Brace motioned to adopt a similar resolution as suggested by the United States Conference of Mayors and forward to our State Senators and Congress person.  Mr. Lashendock seconded the motion.  The motion was carried with all in favor.

County and Municipal Green Acres Projects-Excepting applications until Oct. 6, 2007.

Town of Deerpark -September 11 Memorial Service

PUBLIC PARTICIPATION

Mr. Lashendock motioned to open to the public.  Mr. Brislin seconded the motion. The motion was carried with all in favor.

The following residents had comments.

-Mark Krebs commented on the campaign  election signs which have been posted throughout the town and suggested the Township consider adopting a local ordinance with certain restrictions.

-Reginald R. Cole commented on the Beerskill retaining wall on private property.

-Charles Teufert commented on the Cell Tower application before the Land Use Board.

-Mr. Brislin motioned to close public participation.  Mr. Lashendock seconded the motion.  The motion was carried with all in favor.

ADJOURN

Mr. Lashenodock motioned to adjourn meeting.  Mr. Barbagallo seconded the motion.  The motion was carried with all in favor.
