MINUTES OF MONTAGUE TOWNSHIP COMMITTEE MEETING
July 10, 2007

Mayor Utter called the meeting to order and stated that the meeting was being held in compliance with the Open Public Meetings Act P.L.1975, C. 231 and has been duly advertised.

Those present were Mr. Lashendock, Mr. Barbagallo, Mr. Brace, Mr. Utter, Attorney Hinkes and Clerk Francisco. Mr. Brislin was excused.

All present were asked to salute the flag.

Mr. Lashendock motioned to open to the public comments on agenda items only. Mr. Barbagallo seconded the motion. The motion was carried with all in favor.

No public comments were made.

Mr. Lashendock motioned to close to the public. Mr. Barbagallo seconded the motion. The motion was carried with all in favor.

MINUTES
Mr. Barbagallo motioned to approve the minutes of June 12, 2007. Mr. Lashendock seconded the motion. The motion was carried with all in favor.

Mr. Lashendock motioned to approve the minutes of June 26, 2007. Mr. Brace seconded the motion. The motion was carried with all in favor.

Mr. Lashendock motioned to approve the minutes of June 26, 2007, Executive Session. Mr. Brace seconded the motion. The motion was carried with all in favor.

RESOLUTIONS

R 2007-47 REFUND OF PREVIOUS YEAR’S TAXES DUE TO TAX COURT JUDGEMENT BLOCK 7, LOT 33.10.
Mr. Barbagallo motioned to adopt the above mentioned resolution. Mr. Brace seconded the motion. The motion was carried by a unanimous roll call vote of those present.

R 2007-48 OUTSIDE LIEN REDEMPTION
Mr. Barbagallo motioned to adopt R 2007-48. Mr. Lashendock seconded the motion. The motion was carried by a unanimous roll call vote of those present.

R 2007-49 REFUND TAX PAYMENT MADE ON WRONG PROPERTY
Mr. Lashendock motioned to adopt R 2007-49. Mr. Brace seconded the motion. The motion was carried by unanimous roll call vote of those present.

R 2007-50 GOVERNING BODY CERTIFICATION OF THE ANNUAL AUDIT
Mr. Barbagallo motioned to adopt R 2007-49. Mr. Lashendock seconded the motion. The motion was carried by a unanimous roll call vote of those present.

R 2007-51 IN REM FORECLOSURES
Mr. Barbagallo motioned to adopt R 2007-51 subject to attorney review. Mr. Lashendock seconded the motion. The motion was carried by a unanimous roll call vote of those present.

R 2007-52 PLACE TO PLACE LIQUOR LICENSE TRANSFER- EXTENTION OF PREMISES.
Mr. Barbagallo motioned to adopt R-2007 52. Mr. Lashendock seconded the motion. The motion was carried by a roll call vote. Mr. Utter abstained.

BILLS LIST
Mr. Barbagallo motioned to approve the bills list and vouchers. Mr. Brace seconded the motion. The motion was carried by a unanimous roll call vote of those present. Mr. Utter abstained from voting on the vouchers for Pinzone Construction and Tri County Refrigeration.

NEW BUSINESS

Minisink Reformed Church Request For Waiver of Fees.
Mr. Barbagallo motioned to waive any application fees and request that the Land Use Board not send application for professional review. Mr. Lashendock seconded the motion. The motion was carried by a roll call vote of those present and Mr. Brace abstained.

Blue Light Permit- Keith Lamberson
Mr. Barbagallo motioned to approve the blue light permit application submitted by Keith Lamberson. Mr. Lashendock seconded the motion. The motion was carried with all in favor.

UNFINISHED BUSINESS

Housing Inspections
Mr. Brace motioned to table discussion. Mr. Barbagallo seconded the motion. The motion was carried with all in favor.

Fire Department Funding
Mr. Lashendock motioned to table discussion until first meeting in August. Mr. Brace seconded the motion. The motion was carried with all in favor.

Mr. Brace motioned to amend the agenda under New Business to include Montague Day Expenses. Mr. Barbagallo seconded the motion. The motion was carried with all in favor.

Mr. Barbagallo motioned to approve the expenses submitted by Beverly Bereggo secretary of the Recreation Committee totaling $3250.00. Mr. Lashendock seconded the motion. The motion was carried with all in favor.

REPORTS
Tax Collector’s report month of June- $100,582.00, year to date $3,807,482.50
Fire Department report for the month of June.
Mr. Brace motioned to accept above reports. Mr. Lashendock seconded the motion. The motion was carried with all in favor.

CORRESPONDENCE
Historic Marker –Letter of award for the 2007 Historic Marker Allotment.
Tax Rate 2007- Reported as 3.47
The above correspondence was acknowledged by the Township Committee.

PUBLIC PARTICIPATION
Mr. Barbagallo motioned to open to the public. Mr. Lashendock seconded the motion. The motion was carried with all in favor. Mr. Barbagallo motioned to close to the public. The motion was carried with all in favor.
Mr. Lashendock motioned to go into executive session to discuss a demolition lien. Mr. Brace seconded the motion. The motion was carried with all in favor.

WHEREAS the Township of Montague, County of Sussex, State of New Jersey, finds it necessary to discuss matters relating to litigation and
WHEREAS the Township of Montague, Township Committee believes it to be in the best interest of the public to discuss only those matters in closed session.
NOW THEREFORE BE IT RESOLVED by the Township Committee of the Township of Montague, County of Sussex, State of New Jersey, that it shall enter into closed session to discuss only matters mentioned above, the result of which may be made public immediately thereafter or at a later date.

The Committee returned from executive session and the following action was taken.
Mr. Barbagallo motioned to discharge the Demolition Lien on Blk 18.43 Lot 66, New Road, Montague. Mr. Lashendock seconded the motion. The motion was carried by a unanimous roll call vote of those present.

ADJOURN
Mr. Barbagallo motioned to adjourn meeting. Mr. Lashendock seconded the motion. The motion was carried with all in favor.
