MINUTES OF MONTAGUE TOWNSHIP COMMITTEE MEETING
July 24, 2007

Mayor Utter called the meeting to order and stated that the meeting was being held in compliance with the Open Public Meetings Act P.L.1975, C. 231 and has been duly advertised.

Those present were Mr. Lashendock, Mr. Brislin, Mr. Barbagallo, Mr. Brace, Mr. Utter, Attorney Hinkes and Clerk Francisco.
All present were asked to salute the flag.

Mr. Lashendock motioned to open to the public comments on agenda items only. Mr. Barbagallo seconded the motion. The motion was carried with all in favor.

No public comments were made.

Mr. Lashendock motioned to close to the public. Mr. Barbagallo seconded the motion.
The motion was carried with all in favor.

Minutes

July 10, 2007- Mr. Brace motioned to approve the minutes of July 10, 2007. Mr. Lashendock seconded the motion. The motion was carried by a voice vote. Mr. Brislin abstained.

BILLS LIST

Mr. Barbagallo motioned to approve the bills list. Mr. Brislin seconded the motion. The motion was carried by a unanimous roll call vote.

Resolutions

R 2007-053 GRACE PERIOD FOR AUGUST PAYMENT OF 2007 TAXES
Mr. Barbagallo motioned to adopt the above referenced resolution. Mr. Brace seconded the motion. The motion was carried by unanimous roll call vote.

R 2007-054 OUTSIDE LIEN REDEMPTION
Mr. Barbagallo motioned to adopt the above referenced resolution. Mr. Brislin seconded the motion. The motion was carried by a unanimous roll cal vote.

R 2007-055 AUTHORIZATION TO CANCEL TOWNSHIP TAX SALE CERTIFICATE.
Mr. Lashendock motioned to adopt the above referenced resolution. Mr. Barbagallo seconded the motion. The motion was carried by a unanimous roll call vote.

NEW BUSINESS

Mayor Utter commented on Montague Day and thanked the Recreation Department members, Ken O'Connor, Charles Teufert, John Soracco, John Donavan, Beverly Berrego, Diane Brauchle, and Rick Brahm for their planning. Mr. Brislin also thanked those
who participated in the Mr. and Miss Montague Pageant.

Sussex County Economic Development Partnership, Mary Emilius, Director of Client and Community Services presented to the Township Committee. She summarized to the Township Committee what the Sussex County Development Partnership is about and what they offer.

ANNIVERSARY OF THE MONTAGUE SENIORS - Montague Senior president Ruth Owen requested one member of the Township Committee to participate on a committee for the 30th Anniversary Celebration. Mr. Brislin volunteered to be on the Committee. Mr. Utter volunteered to the alternate. The Senior President also requested a file cabinet for the Seniors to be kept within the Municipal Building.

BLUE LIGHT PERMIT APPLICATION - Mr. Barbagallo motioned to approve the Blue Light Permit Application submitted by Benjamin Edmund Falkowski. Mr. Brace seconded the motion. The motion was carried with all in favor.

2007 LEAGUE OF MUNICIPALITIES - No action was taken. Interested committee members and employees are to contact the Clerk with requests to be reviewed by the committee at a later date.

BLK 19, Lot 45.01, 134 Deckertown Turnpike- Mr. Barbagallo motioned to have the Municipal Attorney review the documents associated with accepting the property as a donation and to table further discussion until next meeting. Mr. Brace seconded the motion. The motion was carried with all in favor.

UNFINISHED BUSINESS

Housing Inspections
Mr. Utter read the correspondence from the Construction Official regarding owner occupied units. Privacy issues were also discussed. Mr. Barbagallo motioned to table discussion. Mr. Brislin seconded the motion. The motion was carried with all in favor.

Grants
Flood Mitigation Grants, Hazard Mitigation, and Pre-disaster Mitigation grants and repetitive loss grants. Mr. Barbagallo motioned to proceed with applications in coordination with the Flood Mitigation Committee and Emergency Management Coordinator. Mr. Lashendock seconded the motion. The motion was carried with all in favor.

Clean-up Benekill
Mayor Utter reported that he and Deputy Mayor Lashendock attended a meeting with the Delaware Basin Commission and the Army Corp of Engineers. The Army Corp Engineers stated at that meeting that they do not have any plan in effect to consider helping the township clean-up the debris currently in the Benekill. The ice jam project The Army Corp of engineers stated that they did not take into consideration what would happen in flood stages in the River. They were only consideration was the ice jam. Mr. Utter stated that he would continue to pursue any options. Mr. Lashendock added that there is currently a long term flood mitigation program which currently in process for the future.

9-1-1 PSAP Consolidation Project
Mr. Lashendock motioned to table discussion. Mr. Brace seconded the motion. The motion was carried with all in favor.

Census
Correspondence from Eric Snyder Sussex County recommending the township participate in LUCA. The administrative chair and co-chair person will look more closely at LUCA and report back to the committee. Mr. Lashendock motioned to table discussion. Mr. Brace seconded the motion. The motion was carried with all in favor.

Transoption Grant- Bike Path Study
A check was received by the Township to do the Bike Path Study the amount of $5000.00 and it was noted that thanks be given to
Laura Bale, Henry Zeeuw and Paul Brislin, for there participation.

REPORTS

Board of Health
Mr. Brislin motioned to accept the Board of Health Report. Mr. Brace seconded the motion. The motion was carried by a voice vote. Mr. Lashendock and Mr. Barbagallo abstained.

CORRESPONDENCE

Protecting New Jersey - Preparing for and protecting New Jersey from Catastrophe

Tax Collector Certification of Mailing of Tax Bills- Mr. Barbagallo motioned to approve the Tax Collectors certification of the mailing of tax bills. Mr. Brislin seconded the motion. The motion was carried with all in favor.

Tri-State Chamber of Commerce- 12th Annual Classic 10 K Race- Mr. Barbagallo motioned to approve the race. Mr. Lashendock seconded the motion. The motion was carried with all in favor.

Interlocal Agreement for Shared Service w/ Frankford Joint Municipal Court Correspondence from Superior Court Assignment, Judge Theodore Bozonellis was read by
Mayor Utter.

PUBLIC PARTICIPATION

Mr. Brislin motioned to open to the public. Mr. Lashendock seconded the motion. The motion was carried with all in favor.

Resident Reginald Cole spoke to the Committee regarding a Health Ordinance inspections and limitations regarding inspections.

Resident Mark Krebs asked if a Deputy Court Administrator would be here one day a week to take complaints, payments to make it easier for residents.

Resident Laurie Coss was present to discuss her spouse David Coss' qualifications as Emergency Management Coordinator for Montague Township and his appointment in 1992.

Resident Louanne Cular was present to and spoke to the Committee regarding her qualifications and appointment as Deputy Emergency Management Coordinator for Montague Township. She also asked the Committee to review the Bike Path Map
provided by the Township's Engineering firm.

Resident Jesse Brace was present and spoke to the Committee regarding his qualifications and appointment as Deputy Emergency Management Coordinator and would be happy to discuss with anyone information regarding Township's Office of Emergency
Management.

Resident John Donavan suggested the people of Montague Township get involved in the upcoming 250th Anniversary Celebration of Montague Township.

Mr. Brislin motioned to close public participation. Mr. Lashendock seconded the motion.
The motion was carried with all in favor.
