MINUTES OF MONTAGUE TOWNSHIP COMMITTEE MEETING
February 26, 2008

OPENING STATEMENT
Mayor Barbagallo called the meeting to order at 6:10 p.m. and stated that the meeting was being held in compliance with the Open Public Meetings Act PL. 1975 C. 231 and has been duly advertised, and that Flag Salute would be dispensed until after Executive Session.

Mr. Utter motioned to go into executive session for the purpose of interviewing engineers for the preparation of tax maps. Mr. Brace seconded the motion, and it was carried with all in favor.

RESOLUTION

R 2008-029A

RESOLUTION AUTHORIZING EXECUTIVE SESSION PURSUANT TO N.J.S.A. 10:4-12

WHEREAS the Township Committee of the Township of Montague, Sussex County, New Jersey, in compliance with the Open Public Meetings Act, N.J.S.A. 10:4-6 et seq., finds it necessary to convene an executive session to discuss matters relating to employment relationship;

NOW THEREFORE , BE IT RESOLVED that the Township Committee will enter executive session. It is anticipated that the deliberation conducted in closed session may be disclosed to the public upon the determination of the Township Committee that the public interest will no longer be served by such confidentiality and if not then legally privileged.

Mr. Utter motioned to adjourn executive session. The motion was seconded by Mr. Brace, and it was carried with all in favor.

The regular session reconvened at 7:00 p.m.

ROLL CALL
Those present were Mr. Brace, Mr. Brislin, Mr. Teufert, Mr. Utter, Mr. Barbagallo Attorney Padula, and Diana Francisco, Clerk.

PUBLIC PARTICIPATION REGARDING AGENDA ITEMS

Mr. Tuefert made a motion to amend the agenda to include a discussion about Clove Road. Mr. Brace seconded the motion. The motion was carried with all in favor.

MINUTES

Mr. Tuefert made a motion to table the approval of Minutes of February 19, 2008 Regular Session and February 19,. 2008 Special Session. Mr. Utter seconded the motion, and it was carried with all in favor.

RESOLUTIONS

R 2008-022 ADOPTION OF THE NATIONAL INCIDENT MANAGEMENT SYSTEM
Mr. Brace motioned to adopt R 2008-022. Mr. Utter motioned to table discussion. Mr. Brace seconded the motion and it was carried with a unanimous roll call vote.

R 2008-026 TRANSFERS
Mr. Brislin motioned to approve the resolution. Mr. Brace seconded the motion, and it was carried by a unanimous roll call vote.

R 2008-027 RESOLUTION TO REJECT THE SOLICITED TRACTOR MOWER BIDS
Mr. Brace motioned to approve the resolution. Mr. Tuefert seconded the motion, and it was carried by a unanimous roll call vote.

R 2008-028 AUTHORIZATION TO RE-SOLICIT BIDS FOR THE TRACTOR MOWER
Mr. Brace motioned to approve the resolution. Mr. Teufert seconded the motion, and it was carried by a unanimous roll call vote.

ORDINANCES

ORD 2008-0001 AN ORDINANCE AMENDING CHAPTER 34, DOGS OF THE CODE OF THE TOWNSHIP OF MONTAGUE
Mr. Brislin motioned to approve the resolution. Mr. Tuefert seconded the motion, and it was carried by a unanimous roll call vote.

UNFINISHED BUSINESS

Plan Endorsement - Mr. Brace motioned to table discussion until next meeting. Mr. Utter seconded the motion. The motion was carried by a unanimous roll call vote.

Coss Lane Drainage Easement - Drainage map submitted by KSM: Mr. Teufert motioned to table until receipt of engineering map. Mr. Brace seconded, and the motion was carried by a unanimous roll call vote.

Municipal Building Back Door Entrance - Mr. Brace motioned to table. Mr. Brace seconded the motion and it was carried with all in favor.

Beerskill Road and Retaining Wall - Mr. Utter motioned to have Attorney Padula review the agreement and report back to the committee. Mr. Brace seconded the motion, and it was carried with all in favor.

NEW BUSINESS

Lawn Maintenance Price Quotes - Mr. Brace motioned to table discussion pending the receipt of one more bid. Mr. Utter seconded the motion, and it was carried with all in favor.

School Grounds Agreement - Ken O'Connor announced that the School Board wishes to enter into a mutual agreement with the Township Committee regarding the ball field. He presented a draft agreement and survey map of the property.

Clove Road Closing - After discussion regarding the time frame and consequences of the County closing Clove Road for bridge repair, it was agreed that Mr. Risco at the County level would be contacted for further explanation.

CORRESPONDENCE

Request for speed limit ordinance from Community Corporation of Highpoint, Inc. - Attorney Padula requested the Committee discuss this with him in Executive Session.

Annual Tax Lien Sale April 17th at 10:30 a.m. - Mayor Barbagallo advised the public.

High Point Hill Climb Time Trial Bicycle Race Request for Approval - Mr. Brace motioned to approve. Mr. Tuefert seconded, and the motion was carried by a unanimous roll call vote.

Mr. Brace made a motion to open to the public. Mr. Tuefert seconded the motion, and it was carried with all in favor.

PUBLIC PARTICIPATION

Louanne Cular voiced concern over closing Clove Road during the bridge repair and the impact on emergency services. She urged Committee to ensure a temporary bridge be constructed by the County.

Reginald Cole expressed his concern over gas consumption by the Fire Department and what he views as a failure by the Township to produce documentation regarding same. Mr. Utter made a recommendation to the Committee to get quotes out for a card reading system.

Mrs. Van Wagner - questioned the Committee about accidents on Clove Road and whether the speed limit was being re-evaluated. She also inquired as to the price of dog licenses and fines.

Mr. Teufert made the following public announcements: Recreation Committee has scheduled July 19th for Montague Day, with a rain date of July 20th. The Montague 250th Committee will be having a meeting April 3. The public is invited and anyone who wants to be involved in planning and coordinating that event can attend.

Mr. Teufert made a motion to close to the public. Mr. Brace seconded the motion, and it was carried with all in favor.

Mr. Teufert made a motion that Committeeman Utter's name be removed from the acceptance of R-2008-022 and change his vote to abstention. The motion was seconded by Mr. Utter, and it was carried by a unanimous roll call vote.

Mr. Teufert motioned to go into Executive Session for general personnel issues and attorney-client information. . Mr. Utter seconded, and the motion was carried with all in favor.
