OPENING STATEMENT
Mayor Barbagallo opened the meeting at 7:05 p.m. announcing that adequate
notice has been provided to the New Jersey Herald and the Sunday New
Jersey Herald for publication in which notice was given of the date,
time, place and general agenda of meetings in accordance with the Open
Public Meetings Act.
FLAG SALUTE
All present were asked to join in the Pledge of Allegiance.
ROLL CALL
Present were Mr. Brace, Mr. Brislin, Mr. Utter, Mr. Teufert, Mayor Barbagallo,
Attorney Padula and Clerk Francisco.
PUBLIC PARTICIPATION REGARDING AGENDA ITEMS
Mr. Utter mentioned that while speaking to a number of residents, he
learned they did not attend the meetings because they were not given
the opportunity to bring up their concerns at the start of the meeting,
and preferred not to wait through the entire meeting to speak. He motioned
to allow any items (not agenda only) be brought up as long as the speaker
does not go over a three minute time limit. Mr. Teufert seconded the
motion, and it was carried with all in favor.
There being no member of the public wishing to be heard, Mr. Utter motioned
to close to the public. Mr. Teufert seconded, and the motion was carried
with all in favor.
TOWNSHIP PROPERTY AUCTION
The seven Township owned parcels in the High Point community were bid
on and sold to Community Corp. of High Point for $1.00 each.
MINUTES
Mr. Brace motioned to approve the minutes of October 14, 2008 Regular
and Executive Sessions. Mr. Utter seconded, and the motion was carried
by a majority voice vote, Mr. Teufert abstaining.
DEPARTMENT OF PUBLIC WORKS
Dave Berhman submitted his written report.
RESOLUTIONS
R 2008-99
AUTHORIZATION TO PROVIDE FOR THE PURCHASE OF ROAD SALT FOR
THE DEPARTMENT OF PUBLIC WORKS OF THE TOWNSHIP OF MONTAGUE.
Mr. Teufert made a motion to approve the Resolution. Mr. Brace seconded,
and the motion was carried with all in favor. After a brief discussion
among the committee, it was explained this motion was approved to allow
for the option only, that it was not a commitment to purchase salt from
the County.

WEIDER ROAD CHANGE ORDER RESOLUTION
Mr. Teufert motioned to approve the Resolution. Mr. Brace seconded, and
the motion was carried by a majority roll call vote: Mr. Brace, yes;
Mr. Brislin, no; Mr. Teufert, yes; Mr. Utter, yes; Mr. Barbagallo,
yes.

COSS LANE SPENDING ORDINANCE
Mr. Teufert motioned to approve the Ordinance. Mr. Brace seconded, and
the motioned was carried by a majority roll call vote: Mr. Brace, yes;
Mr. Brislin, no; Mr. Teufert, yes; Mr. Utter, yes; Mr. Barbagallo, no.
NEW BUSINESS
911 - NEWTON DISPATCH CONTRACT RENEWAL
Mayor Barbagallo made a motion
to table this matter until the next meeting in order to look at neighboring
municipalities for comparison pricing. Mr. Brislin seconded, and the
motion was carried by a unanimous roll call vote.
Property Next Door to Municipal Building
Mayor Barbagallo indicated
he had gotten a call from Bob Labot, owner of the property, who offered
the property for the same price at which he purchased it. Mr. Brace made
a motion to call the law firm of Laddy, Clark & Ryan to ascertain
the exact price and the terms of the Contract for Sale. Mr. Teufert seconded
the motion, and it was carried by a majority roll call vote: Mr. Brace,
yes; Mr. Brislin, yes; Mr. Teufert, no; Mr. Utter, yes; Mr. Barbagallo,
yes.
Mr. Teufert announced that Recreation is sponsoring
a Montague Ski Club where Black Bear in Lackawaxen, Pa. is offering discount passes. Sign-ups
will be on November 19th between 6 pm and 9pm at the school cafeteria.
Achievement Recognition
Mr. Brislin and Clerk Francisco noted that
a number of employees are attending classes to enhance their municipal
positions. Mayor Barbagallo added that there are volunteers in the town,
naming David Coss and Louanne Cular who have devoted many years of service
benefitting the town and should be recognized as well. He asked that
someone think up a way in which to thank these people for their service
to our community.
UNFINISHED BUSINESS
Salt and Grit Contract with Morris County Co-op
Mr. Brislin motioned
to approve. Mayor Barbagallo seconded, and the motion was carried by a
unanimous roll call vote.
Model Personnel Policy Manual
Mr. Teufert motioned to have the municipal
department heads review the manual and provide comments. Mr. Brislin
seconded, and the motion was carried with all in favor.
Rural Policing
Mr. Utter made a motion to write a letter of thanks
to Wantage and their legal counsel for their due diligence in achieving
a major victory in eliminating payment to the State for Rural Policing.
Mr. Barbagallo seconded, and the motion was carried with all in favor.
APPLICATIONS
Blue Light Permit
Rebecca Hamler. Mr. Teufert motioned to approve the
application. Mr. Brace seconded, and the motion was carried with all
in favor.
REPORTS
Fire Department - September Report accepted
- to be posted on the bulletin board.
CORRESPONDENCE
Mayor’s invitation for Freeholders meeting to discuss recent happenings
in Trenton. Mayor Barbagallo indicated that any committeeman may attend
the meeting.
Municipal Revenue Restoration Act - Mayor Barbagallo read the letter
with accompanying sample Resolution. No action was taken.
Clove Road - Mr. Brace questioned whether the road would be straightened
out. Mayor Barbagallo said he was told the County was going to fix it.
A letter will be sent asking when the repairs will be made.
PUBLIC PARTICIPATION
Mr. Teufert motioned to open to the public. Mr. Brislin seconded, and
the motion was carried with all in favor.
Richard Clauberg - suggested a commercial appraisal for the property
next to the municipal building. He also suggested the township establish
a housing authority to buy up property and re-rent it to senior citizens
in order to control a number of small units in town.
Reginald Cole - announced that he filed an official complaint against
the Montague election with the Governor’s office and the Election
Board regarding limited parking spaces.
Dorothy Ames - indicated that Byram Township is working on using existing
housing to fulfill a percentage of COAH, and that she would volunteer
with Mr. Clauberg to get in touch with people in Byram to get their thoughts
on starting up a housing authority committee.
Mark Krebs - asked the cost of the 911 Dispatch contract and was read
the amounts for 2009- $43,160.00 , 2010- $44,887.00, 2011- $46,683.00.
There being no other member of the public wishing to be heard, Mr. Brislin
motioned to close to the public. Mr. Teufert seconded, and the motion
was carried with all in favor.

Mr. Brislin motioned to adjourn. Mr. Brace seconded the motion. The
motion was carried with all in favor and the meeting was adjourned.
