MINUTES OF MONTAGUE TOWNSHIP COMMITTEE MEETING

April 14, 2009

OPENING STATEMENT
Mayor Barbagallo opened the meeting announcing that adequate notice has been provided to the New Jersey Herald and the Sunday New Jersey Herald for publication in which notice was given of the date, time, place and general agenda of meetings in accordance with the Open Public Meetings Act.

FLAG SALUTE
All in attendance were asked to join in the Pledge of Allegiance.

ROLL CALL
Present were Mr. Brace, Mr. Teufert, Mr. Zitone, Mr. Ponce, Mayor Barbagallo, Attorney Garofalo and Clerk Francisco.

PUBLIC PARTICIPATION
No one from the public wished to be heard.

MINUTES
Mr. Ponce motioned to approve the Minutes of the March 24, 2009 Regular and Executive sessions. Mr. Teufert seconded, and the motion was carried with all in favor.

DEPARTMENT OF PUBLIC WORKS

DPW Foreman Dave Berhman reported that the department has been working on cleaning drains, patching potholes and removing roadside debris in an around the township, and that work had also begun on the catch basins. Projected work includes repair of guardrails and preparation of the yard for the Clean Up Weekend. Mayor Barbagallo commended the crew on the street sweeping, which had not been completed by this time last year.

PAYMENT OF VOUCHERS
Mr. Brace motioned to approve the vouchers. Mr. Teufert seconded the motion. Mayor Barbagallo asked the committee if they would agree to hold the KSM Engineering check for pickup since the engineering report for Beerskill Road is three weeks overdue. The committee agreed, and the motion was carried by a unanimous roll call vote.

R 2009-35 SUPPORT OUR TROOPS
Mr. Teufert motioned to adopt the resolution. Mr. Ponce seconded, and the motion was carried with A unanimous roll call vote.

R 2009-36 AUTHORIZATION TO CANCEL TOWNSHIP TAX SALE CERTIFICATES
Mr. Teufert motioned to adopt the resolution. Mr. Brace seconded, and the motion was carried by a unanimous roll call vote.

R 2009-37 OUTSIDE LIEN REDEMPTION
Mr. Teufert motioned to adopt the Resolution. Mr Brace seconded, and the motion was carried with all in favor.

R 2009-38 RESOLUTION IN OPPOSITION TO GOVERNOR CORZINE’S FY2010 STATE BUDGET
Mayor Barbagallo motioned to adopt the Resolution. Mr. Brace seconded, and the motion was carried by a unanimous roll call vote.

ORDINANCES (First Reading)
Ord 2009-10
AN ORDINANCE AMENDING CHAPTER 25 OF THE CODE OF MONTAGUE TOWNSHIP FROM “BINGO” TO “RAFFLE AND BINGO LICENSING” AND TO ADD SECTION 25-2 DELEGATING MUNICIPAL CLERK AS AUTHORITY FOR APPROVAL OF LICENSES

Mr. Teufert motioned to approve the ordinance. Mr. Zitone seconded, and the motion was carried by a unanimous roll call vote.

UNFINISHED BUSINESS
Helipad Update - Clerk Francisco advised the committee that she had received approval from the FAA and an email from the Toll Bridge Commission inquiring as to the status of the application.

Pre-Petition meeting with Office of Smart Growth available dates - Attorney Garofalo explained that this meeting is essentially instructional as to how to get plan endorsement. Mr. Teufert indicated his willingness to attend along with Planner Jessica Caldwell, who will select one of the offered dates.

Deputy Emergency Management Coordinator - Mr. Teufert motioned to appoint Jesse Brace. Mayor Barbagallo seconded, and the motion was carried by a majority roll call vote, Mr. Brace abstaining.

Next Budget Meeting Date - Monday April 20 at 4:00 p.m.

GRC Complaint Dismissed - Mayor Barbagallo indicated that this was a dismissal of charges regarding an old Hamburger Helper matter.

NEW BUSINESS
2009 Spring Clean Up - Clerk Francisco indicated she had received price quotes from Northern Sanitation and Waste Management.

NJDOT Municipal Aid in support of walking and bikeways - Mayor Barbagallo indicated that this is a grant he is working on, that getting help from the State is fairly remote, but that he will nevertheless move forward with it.

2009 Summer Hours - Tabled to next meeting

Volunteer Dinner - Clerk Francisco suggested Wednesday May 20th. The committee agreed.

Use of Facility by Girl Scouts - Mr. Brace motioned to grant a request by the Girl Scouts to use the meeting room on May 16th for a number of hours. Mr. Ponce seconded, and the motion was carried with all in favor.

APPLICATIONS
Fire Department Raffle Application - Mr. Brace motioned to approve the application. Mr. Teufert seconded, and the motion was carried with all in favor.

2009 Summer Hours - Tabled until the next meeting.

APPLICATIONS
Mr. Teufert motioned to approve the Blue Light Permit application of Kyle Gottemoller. Mr. Brace seconded, and the motion was carried with all in favor.

REPORTS
Tax Collector - Month of March 107,018.00
                      Year to Date 1,988.553.00

Mr. Teufert will see that the proper signage is placed above the Merusi-Youngman field in accordance with the Farm Service regulations.

CORRESPONDENCE
Tax Collector’s request to attend Conference - Mr. Teufert motioned to approve the request. Mr. Zitone seconded, and the motion was carried by a unanimous roll call vote.

Clean Communities Entitlement - Mayor Barbagallo read a letter from the State to assist in development of the budget indicating Montague’s entitlement of $6,802.42.

Letter Regarding Riverview Court - explains confusion between all the ‘Riverview’ roadways. Mr. Brace indicated he had spoken with Tax Assessor Melissa Rockwell, who said the problem should be cleared up with the completion of the new tax map.

PUBLIC PARTICIPATION
Mr. Teufert motioned to open to the public. Mr. Brace seconded, and the motion was carried with all in favor. There being no member of the public wishing to be heard, motion to close to the public was carried with all in favor.

Mr. Teufert motioned to enter executive session to discuss personnel without taking action. Mr. Brace seconded, and the motion was carried with all in favor.

RESOLUTION AUTHORIZING EXECUTIVE SESSION

R 2009-

WHEREAS the Township of Montague is authorized, pursuant to N.J.S.A. 10:4-12 to exclude the public from that portion of this meeting for purposes of discussing specific matters as permitted by N.J.S.A. 10:4-12; and

WHEREAS the Township intends to discuss certain matters which are deemed confidential pursuant to N.J.S.A. 10:4-12 in Executive Session; and

WHEREAS at this time the Township cannot determine the time when the discussions to be held in Executive Session will be made public, but will disclose the minutes of the Executive Session when the need for confidentiality no longer exists.

NOW THEREFORE, be it resolved by the Township Committee of the Township of Montague that this meeting shall be adjourned to an executive session (closed session) and the public will be excluded in order that the Committee may, in accordance with N.J.S.A. 10:4-13(a), discuss personnel, and after reconvening this public meeting the Mayor or his designee will announce, if possible, the time when and the circumstances under which the discussion conducted in Executive Session will be disclosed to the public. This resolution is authorized and allowed by and pursuant to N.J.S.A. 10:4-13.

NOW THEREFORE, be it further resolved by the Township Committee that pursuant to N.J.S.A. 10:4-13(b) the time when and the circumstances under which the discussion conducted in closed session of the public body can be disclosed to the public is when the need for confidentiality no longer exists.

Mr. Teufert motioned to close Executive Session and return to public Session. Mr. Brace seconded, and the motion was carried with all in favor.
