MINUTES OF MONTAGUE TOWNSHIP COMMITTEE MEETING

May 26, 2009

OPENING STATEMENT
The Montague Girl Scouts opened the meeting at 7:01 p.m. announcing that adequate notice has been provided to the New Jersey Herald and the Sunday New Jersey Herald for publication in which notice was given of the date, time, place and general agenda of meetings in accordance with the Open Public Meetings Act.

SPECIAL PRESENTATION - GIRL SCOUTS REORGANIZATION MEETING
Montague’s local Girl Scout Troop 889 entertained and impressed the adult audience with their mock reorganization meeting consisting in part of honorary appointments of Clerk, Attorney and Constable; Committee Reports, and a Proclamation of Man on the Moon Day. After their presentation and a huge round of applause, pictures were taken to commemorate the event. Honorary Mayor Alyssa Borrego then turned the meeting over to Mayor Barbagallo..

PUBLIC PARTICIPATION
No one from the public wished to be heard.

MINUTES
Mr. Teufert motioned to approve the Regular and Executive Session Minutes of the May 12, 2009 meetings. Mr. Zitone seconded, and the motion was carried with all in favor.

RESOLUTIONS

R 2009-47 CANCELLATION OF TAX SALE PREMIUMS TO SURPLUS
Mr. Brace motioned the approve the Resolution. Mr. Teufert seconded, and the motion was carried by a unanimous roll call vote.

R 2009-48 AUTHORIZATION ISSUANCE OF DUPLICATE TAX SALE CERTIFICATE
Mr. Brace motioned to approve the Resolution. Mr. Zitone seconded, and the motion was carried by a unanimous roll call vote.

R 2009-49 RESOLUTION TO AMEND THE PLAN ENDORSEMENT CITIZENS’ ADVISORY COMMITTEE
Mr. Brace motioned to table the Resolution. Mr. Teufert seconded, and the motion was carried with all in favor.

R 2009-50 AUTHORIZING THE 2009 MUNICIPAL BUDGET DOCUMENT TO BE READ BY TITLE
Mr. Teufert motioned to table the Resolution. Mr. Zitone seconded, and the motion was carried by a unanimous roll call vote.

ORDINANCES

Ord 2009-01
AN ORDINANCE TO AMEND CHAPTER 76 ARTICLE II SECTION 76-7 ENTITLED ZONING FOR THE PURPOSE OF CHANGING THE DEFINITION OF LOT LINE FRONT TO AMEND THE SETBACK REQUIREMENT FOR CORNER LOTS

AN ORDINANCE TO AMEND CHAPTER 76 ARTICLE III SECTION 76-7 ENTITLED DEFINITIONS FOR THE PURPOSE OF CHANGING THE DEFINITION OF BUILDING HEIGHT AS STATED THEREIN

Mr. Brace motioned to table both Ordinances. Mr. Teufert seconded, and the motion was carried by a unanimous roll call vote. Attorney Clark to confer with the Land Use Board attorney before action be taken to approve the Ordinances.

BUDGET - FINAL ADOPTION HEARING
After Attorney Clark advised the committee that no formal action can be taken until authorization has been received from the State, Mr. Teufert motioned to open to the public. Mr. Brace seconded, and the motion was carried with all in favor. After questions, answers, statements and opinions among the committee, the clerk, township auditor Heidi Wohleb and the public, Mr. Teufert motioned to close to the public. Mr. Brace seconded the motion, and it was carried with all in favor.

NEW BUSINESS
Mr. Teufert made a motion to amend the Agenda to add New Business and include confirmation of the Girl Scouts’ ‘official’ actions during their earlier meeting - proclaiming July 20th ‘Man on the Moon Day’ and the displaying of a mural on the lower level of the municipal building. Mr. Brace seconded the motion, and it was carried with all in favor.

UNFINISHED BUSINESS
Beerskill Road Project - Mr. Teufert motioned to table this matter until the next meeting. Mr. Ponce seconded, and the motion was carried with a majority roll call vote, Mr. Zitone abstaining.

Mayor Barbagallo thanked the volunteers for their service to the community.

CORRESPONDENCE
United States Marine Corps Reserve - Commander’s Award recognition for Montague Recreation, Toys for Tots Program - Mayor Barbagallo acknowledged the award and thanked the Recreation Committee for its participation.

PUBLIC PARTICIPATION
Mr. Barbagallo motioned to open to the public. Mr. Zitone seconded, and the motion was carried with all in favor.

Ed Ibold thanked the committee for presenting him with the Senior of the Year award. He stated that when he gets political flyers a week or so ahead of the election that he takes the time to find out if the information is true, and that in his opinion sending out flyers a day or two before the election is dirty politics. Mayor Barbagallo expressed his disagreement with Mr. Ibold’s statements.

Jim Guimes reiterated a political comment he made at the prior meeting that if someone has “a dog in the hunt,” that it be “kept on a short leash.” He also presented Mayor Barbagallo with a picture taken at his concession at High Point Park when the Mayor treated visiting hikers to dinner. He suggested more people get involved with a group called ‘Friends of High Point Park’ to gain positive visibility for the town.

No other member of the public wishing to be heard, Mr. Teufert motioned to close to the public. Mr. Zitone seconded, and the motion was carried with all in favor.

Mayor Barbagallo mentioned a thank you card he received from Karen Goyah, a Montague school teacher, and her class for his participation in a play.

Mr. Teufert motioned to adjourn. Mr. Zitone seconded, and the motion was carried with all in favor.
