Mayor Butto called the session to order at 8:10 p.m. and opened the meeting, stating that the meeting was being held in compliance with the Open Meetings Act, P L 1975, c. 231, and has been duly advertised.
The Acting Clerk was asked to call the roll.

Committeewoman Kaman made a motion to approve the above referenced minutes with the following changes: Reg. Session 8-27-02, page 2 under"Old Business" "OPERA" should be "OPRA" and under "Old Business" "Economic Newsletter" the $500.00 was for printing and does not include postage. She also amended the Motion to include the 9-24-02 Executive Session Minutes.

The second item should be included under Old Business with regard to "Foreclosed Properties" which is a letter from a prospective property owner, Mrs. Keefer, with respect to Block 18, Lot 11.

Resolutions:
Resolution R02-65 - Appointment of Chief Financial Officer: Committeewoman Kaman commented that an uncertified CFO can be appointed for one year for an unexpired term. However, Pam Jerger was tenured and therefore there is no unexpired term anymore. Committeewoman Kaman felt that according to the statute the appointment would be a one year appointment for CFO. The attorney questioned if Michelle LaStarza received her certification yet. The committee indicated that she had not yet received her certification. The attorney indicated this is a one year term, not a one year unexpired term. It was agreed that the term on the resolution should read October 1, 2002 through September 30, 2003
Committeeman Zitone made a motion to approve the Resolution R02-65 for the dates October 1, 2002 through September 30, 2003.

Resolution: R02-66 - Appointment of Township Tax Collector: A discussion was held with regard to the term of the appointment. The attorney indicated that the vacancies other than due to the expirations of term, which is the case in this resolution, shall be filled for the unexpired term. The statute further states that every municipal tax collector shall hold his office for a term of four years from the first day of January next following his appointment. Vacancies other than due to expiration of term shall be filled by appointment for the unexpired term. This resolution will end on December 31, 2002.

Committeeman Kaman questioned the attorney if this property became an assessable property after the day of the closing, then it should be picked up as an added assessment. A discussion was held. The attorney indicated that this committee can do this by a Resolution and the Tax Assessor can do this by an added assessment pursuant to the Resolution. It was agreed that the attorney speak to the township tax assessor with regard to this issue. In the meantime, the committee can approve the Resolution, it can always be rescinded at the next committee meeting.

A discussion was held with regard to a possible water line leak on Spook Ridge Road which is causing the property on this road to be saturated and, therefore, these lots will not perk. It was agreed to have the clerk contact the water company to have them look into this matter and repair the problem.

Robert L. Campbell Associates request for extension of time to complete perk tests on Block 19.03, Lot 32

Purchase of Foreclosed Properties:
Joseph Barbagallo wrote a letter to the township committee requesting the purchase of foreclosed properties Block 18.53, Lot 48 and Block 18.53, Lot 49. These properties were on the auction list, they have been re-advertised after the auction was completed. He would like to purchase them for the minimum bid requirement of $3,766 for lot 48 and $3,866 for lot 49.
Committeeman Zitone made a motion to sell these two lots for the minimum bid mentioned above.

Rose M. Keefer wrote a letter to the township committee requesting the purchase of foreclosed property Block 18, Lot 11. She would like to purchase this lot for the minimum bid requirement of $4,067.00. This is another parcel that did not sell at the auction.

Montague Volunteer Fire Department Monthly Report - August 2002
The Committee recognized receipt of the above mentioned report.
Mayor Butto indicated he received an E-Mail from the Bruno Group with regard to the Steering Committee. They indicated that they are mailing letters to the prospective members of this committee. They have a meeting scheduled for Wednesday October 16th at the Township Building at 5:00.
Applications for membership in the Montague Fire Department:

Committeewoman Kaman made a motion to approve the above mentioned applications.

Steering Committee: Committeewoman Kaman indicated that on the Steering Committee, the committee never finalized who was on the committee. There were a few names that they were not sure of. Committeewoman Kaman also indicated that she would like to be on this committee as a representative of this committee. Mayor Butto indicated he did not know if a member of the Township Committee is able to be on this committee. It was noted that John Soracco and Stanley Dutkus are not on the committee.
Approval of Vouchers - Payment of Bills:
Committeeman Zitone made a motion to pay all bills except the one for Maureen Kaman for a Conference in November for $400.00. Committeewoman Kaman indicated that she will have the other two towns she works for pay part of this conference.

The Motion was carried by a unanimous voice vote.
Reports:
Committeeman Krebs indicated that he has a meeting set up with Richard Klauberg from the Community Corp. of High Point to discuss recreation facilities and possibly next summer opening it up to the residents of the township, the swimming pool and tennis courts, etc.
New Business:
Committeeman Zitone noted that previously the committee admired the individual that lives on Clove Road across the street from Big Z Stables with regard to how he improved his property. The Committee discussed sending a letter to him indicating the township's appreciation. He feels that action should be taken on this.
Correspondence:
Suggestion for "Senior of the Year" from Desmond Finegan. The seniors are suggesting Marqueen Jasuilewicz and William Coughlin as Seniors of the Year.
Committeeman Zitone made a motion to accept the above as "Senior of the Year" for the year 2002
Committeewoman Kaman seconded the motion.

"Dwight Fickes Memorial Fund" from Desmond Finegan. It was noted from Mayor Butto
that this letter was a proposal from Mr. Finegan to keep the captioned fund solvent. Mayor Butto read the letter into the record. Mr. Finegan requested an appointment to the "Clean Comminutes fund" next year. He agrees to donate the salary for this to the above fund.

Dorothy Ames appeared before the committee as a representative of High Point Country Club. She would like the committee to send any communication they receive with regard to the High Point County Club in order that their committee may take action to try and resolve some of these matters.
Desmond Finegan appeared before the committee to inform them that he did speak to his neighbor, the gentlemen on Clove Road the committee is going to send a letter to for improving his property, and told him that the committee did acknowledge how beautiful his yard looks.
Josephine Yarosz appeared to request that the committee consider putting up a speed limit sign on Myrtle Drive.
Maureen Kaman indicated to the board that Lloyd Coss, an ex Mayor Montague, was in the hospital. She felt that a card should be sent to Mr. Coss.
Deputy Mayor Barbagallo made a motion to close this meeting to the public.
