MONTAGUE TOWNSHIP COMMITTEE MEETING

February 12, 2002

Minutes

 

Mayor Butto called the session to order at 8:05 p.m. and opened the meeting, stating that the meeting was being held in compliance with the Open Meetings Act, P>L> 1975, c. 231, and has been duly advertised.

The Clerk was asked to call the roll.

Present were: Committeewoman Kaman, Committeeman Zitone,

Committeeman Barbagallo, Committeeman Krebs, Mayor Butto

Clerk Felter, Atty. Stephen Edelstein

Absent: None

All present were asked to join in the Pledge of Allegiance.

Approval of Minutes: Regular Session January 8, 2002

Committeeman Zitone made a motion to approve the minutes of the regular session of January 8, 2002.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous roll call vote:

Ayes: Committeewoman Kaman, Committeeman Zitone,

Deputy Mayor Barbagallo, Committeeman Krebs, Mayor Butto

Resolutions

R2002-16 Refund of Overpaid Taxes Due To Farmland Assessment

Committeeman Zitone made a motion to approve the above referenced resolutions.

Committeeman Krebs seconded the motion.

The motion was carried by a majority roll call vote:

Old Business

Advertisement for Bids - Rubin Hill Road

Committeeman Zitone made a motion to advertise for bids for the work to be done on Rubin Hill Road upon completion of the specifications.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous roll call vote:

Ayes: Committeewoman Kaman, Committeeman Zitone,

Deputy Mayor Barbagallo, Committeeman Krebs, Mayor Butto

In Rem Tax Foreclosures

Stephen Edelstein, Attorney for the Township advised the Committee that there are 30 pending In Rem foreclosures and the notice for these foreclosures has appeared in the New Jersey Herald last month. Therefore, anybody with an interest in any of the properties has until March 13, 2002 to make it known and to redeem the certificate or to respond and anytime after

March 13, 2002 we can apply for entry of final judgement.

Mr. Edelstein also advised the Committee that there are 46

In Persona foreclosures on which all the title work is completed and they are ready to go. However, it was the decision of the Committee to wait until the In Rem are all completed.

Committeewoman Kaman stated that she felt the Township should go ahead with the In Personas. The Committee agreed.

Committeewoman Kaman made a motion to proceed with the

foreclosure of the In Personas.

Committeeman Zitone seconded the motion.

The motion was passed by a unanimous roll call vote:

Ayes: Committeewoman Kaman, Committeeman Zitone,

Deputy Mayor Barbagallo, Committeeman Krebs, Mayor Butto

Nays: None

Appointments:

Public Defender - James Sloan

Committeeman Joseph Zitone made a motion to appoint James Sloan

Public Defender to be retro-active to January 1, 2002.

Deputy Mayor Barbagallo seconded the motion.

The motion was carried by a unanimous roll call vote:

Ayes: Committeewoman Kaman, Committeeman Zitone,

Deputy Mayor Barbagallo, Committeeman Krebs, Mayor Butto

Welfare Board - Michelle LaStarza

Committeewoman Kaman made a motion to appoint Michelle LaStarza to the Welfare Board.

Deputy Mayor Barbagallo seconded the motion.

The motion was carried by a unanimous roll call vote:

Ayes: Committeewoman Kaman, Committeeman Zito0ne,

Deputy Mayor Barbagallo, Committeeman Krebs, Mayor Butto

Nays: None

Alternate Prosecutor

Action on the above mentioned position was tabled.

New Business

None

Approval of Vouchers - Payment of Bills:

Committeeman Zitone made a motion to approve the bills.

Deputy Mayor Barbagallo seconded the motion.

The motion was carried by a roll call vote:

Ayes: Committeewoman Kaman, Committeeman Zitone,

Deputy Mayor Barbagallo, Mayor Butto

Nays: None

Abstain: Committeeman Krebs

Correspondence:

Request from Mr. Ken Bartro for the Kittatinny Little League to use the Municipal Building for their meetings.

After a very lengthy discussion, the Committee made the decision not to allow outside groups to meet in the Municipal Building, at least until a procedure as to how to handle the opening and closing, keys, alarms etc. can be developed.

Community Corporation of High Point Request to use the

Municipal Building for Their Meetings.

The Committee felt the same reasons for not allowing the

Kittatinny League to meet in the Municipal Building apply to the Community Corporation of High Point and, therefore, they must refuse permission for them to use the Municipal Building.

Frank Walsh - Zoning Department Report

Committeeman Zitone complimented Mr. Walsh on the excellence of

his report.

Public Participation

Committeeman Krebs made a motion to open the meeting to public participation.

Committeewoman Kaman seconded the motion.

The motion was carried by a unanimous voice vote.

Desmond Finegan:

Mr. Finegan had questions concerning the completion of the downstairs library in the Municipal Building and also the grants for the building of a Community Center.

Mr. Finegan also advised that a representative of the

Sheriff=s Department came to the Senior Citizen=s meeting and was made aware of the concerns regarding Clove Road and River Road that the Seniors have.

Linda Pytel:

Mrs. Pytel came to the Committee with a problem she is having with her landlady. The Committee advised her that it appeared to be a tenant - landlord dispute and they had no jurisdiction in that area.

Keith Utter:

Mr. Utter came to the Committee with a problem he has with

Montague=s Construction Department. He feels he is being unfairly singled out. The Committee assured Mr. Utter they will look into the matter.

Mayor Butto asked if anyone else wished to speak. There was no one.

Committeeman Zitone made a motion to close public participation.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous voice vote.
