MONTAGUE TOWNSHIP COMMITTEE MEETING

January 14, 2003

Minutes

Mayor Butto called the session to order at 7:00 p.m. and opened the meeting, stating that the meeting was being held in compliance with the Open Meetings Act, P>L> 1975, c. 231, and has been duly advertised.

The Clerk was asked to call the roll.

Present were: Committeewoman Kaman, Deputy Mayor Zitone,

Committeeman Butto, Committeeman Krebs,

Mayor Barbagallo

Helen F. Felter, Clerk, Denis G. Murphy, Atty.

Absent: None

Executive Session:

Committeeman Butto made a motion to go into executive session.

Committeewoman Kaman seconded the motion.

The motion was carried by a unanimous voice vote.

Committeeman Butto made a motion to reconvene the regular session of the meeting.

Deputy Mayor Zitone seconded the motion.

The motion was carried by a unanimous voice vote.

All present were asked to join in the Pledge of Allegiance.

Approval of Minutes: Regular Session December 24, 2002

Committeeman Krebs made a motion to approve the minutes of

December 24, 2002.

Committeewoman Kaman seconded the motion.

The motion was carried by a unanimous voice vote.

Ordinances:

First Reading:

Ord.2003-01 Re-zoning of Roberts Property

Committeewoman Kaman made a motion to table action regarding the above referenced ordinance.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous voice vote.

Ord.2003-02 An Ordinance to Regulate Excavations in Streets

Committeeman Krebs made a motion to approve Ord. R2003-02 on first reading.

Committeewoman Kaman seconded the motion.

The motion was carried by a unanimous roll call vote:

Committeeman Butto, Committeeman Krebs, Mayor Barbagallo

Nays: None

Ord.2003-03 An Ordinance Setting the Cap Rate Index

Committeeman Butto made a motion to approve Ord. 2003-03 on first reading.

Committeeman Krebs seconded the motion.

The motion was passed by a unanimous voice vote.

Resolutions

R2003-09 Cancellation of Tax Overpayment or Delinquent Amounts Less than $10.00

R2003-10 Outside Lien Redemptions

R2003-11 Authorizing Cancellation of Township Certificates

R2003-12 Refund of Tax Overpayment Block 18.55, Lot 7co102

R2003-13 Transfer Resolution

R2003-13A Resolution Opposing the League of Municipalities Approval of Limiting Public Participation at Meetings

Committeeman Butto made a motion to approve all of the above referenced resolutions.

Committeeman Krebs seconded the motion.

The motion was passed by a unanimous voice vote.

Old Business

Building Department fees

Committeeman Butto made a motion to table any action on the above matter until the next meeting until the Building Inspector

Victor Dai could be present.

Committeewoman Kaman seconded the motion.

The motion was carried by a unanimous voice vote.

Smart Growth

After a short discussion, the Committee appointed

Committeewoman Kaman as the Smart Growth representative for

Montague Township. It was also agreed that the Mayor should be informed of all meetings etc.

Completion of the Municipal Building Downstairs

The Committee received three proposals on the completion of the downstairs. The job was awarded to Richard Jacobs for the lowest proposal of $17,000.00.

Road Safety - M. Kaman

A motion to table discussion on the above referenced matter was made by Committeeman Krebs.

Committeeman Butto seconded the motion.

The motion was carried by a unanimous voice vote.

Financial Coordinator for Senior Citizens-Desmond Finegan

Deputy Mayor Zitone made a motion to appoint Desmond Finegan as the Financial Coordinator for the Senior Citizens.

Committeeman Butto seconded the motion.

The motion was carried by a unanimous voice vote.

Recreation Commission

Committeeman Butto made a motion to table discussion on the appointments to the Recreation Commission.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous voice vote.

New Business

Economic Development

Committeewoman Kaman made a motion to table discussion on the

Economic Development.

Deputy Mayor Zitone seconded the motion.

The motion was carried by a unanimous voice vote.

O.P.R.A

It was the decision of the Committee to pass a resolution opposing the League of Municipality's support of a bill to allow the limiting of public participation.

Two Person Committee to Work With The Mayor on an Attempt to Recover Federal Lands for Use as Education, Recreation & Entertainment

Committeewoman Kaman made a motion to approve the formation of a Committee to work with the Mayor to recover Federal Lands for use as education, recreation & entertainment.

Committeeman Butto seconded the motion.

The motion was carried by a unanimous voice vote.

Cablevision-Closing the Montague Office

Committeewoman Kaman made a motion to have Montague's Attorney to write a letter to Cablevision opposing the closing of their office in Montague.

Committeeman Krebs seconded the motion.

The motion was carried by a voice vote.

Deputy Mayor Zitone abstained.

Approval of Vouchers - Payment of Bills:

Committeeman Butto made a motion to pay all the bills.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous voice vote.

Correspondence:

Eric Snyder & Assoc. Permitting Non-conforming Uses

The Committee requested the Municipal Clerk to forward the above referenced correspondence to the Land Use Board.

Dolan & Dolan Fence Ordinance

The Committee tabled action on the above mentioned Ordinance.

Reports:

Tax Collector's Report of Revenues Collected for December, 2002

Montague Township Volunteer Fire Department Reports for

November, 2002, December 2002 and 2002 Year End

The Committee noted receipt of the above mentioned reports.

Applications:

Red Light Permit-David Coss

Blue Light Permits-Jesse Brace/Revak & Robert B. Hermo

N.J. State Firemen's Association - Michael J. Kooger

Committeeman Krebs made a motion to approve the above referenced applications.

Committeewoman Kaman seconded the motion.

The motion was carried by a unanimous voice vote.

Resignations:

Ruth Owen - Court Administrator

Joseph Lashendock - Member of the Land Use Board

Committeeman Krebs made a motion to accept the above mentioned resignations with regret.

Committeeman Butto seconded the motion.

The motion was carried by a unanimous voice vote.

Public Participation

Committeeman Krebs made a motion to open public participation.

Committeewoman Kaman seconded the motion.

The motion was carried by a unanimous voice vote.

Desmond Finegan

Mr. Finegan advised the Committee that he had sent a letter to Cablevision concerning the closing of the Montague Office.

Mayor Barbagallo mentioned to Mr. Finegan that he should have one of the members of the Committee approve any letter that is written on Township letterhead. Mr. Finegan agreed that he would.

Reginald Cole

Mr. Cole advised the Committee that he felt that

Mrs. Nancy Campana would be a good candidate to fill the vacancy on the Land Use Board. The Committee thanked him for his thoughts.

Mayor Barbagallo asked if anyone else wished to speak. There was no one.

Committeeman Butto made a motion to close public participation.

Committeewoman Kaman seconded the motion.

The motion was carried by a unanimous voice vote.
