MONTAGUE TOWNSHIP COMMITTEE MEETING



October 14, 2003



Minutes





Mayor Barbagallo called the session to order at 7:00 p.m. and opened the meeting, stating that the meeting was being held in compliance with the Open Meetings Act, P>L> 1975, c. 231, and has been duly advertised.



The Clerk was asked to call the roll.



Present were: Committeewoman Kaman, Deputy Mayor Zitone Committeeman Butto, Committeeman Krebs,

Mayor Barbagallo

Helen F. Felter, Clerk, Steven Edelstein, Atty.

Absent: None





Also Present: Advisory Board of Health

Deborah Mulligan, Alice Thon, Maria Carpentier,

Reginald Cole



All present were asked to join in the Pledge of Allegiance.



A joint meeting of the Township Committee and the Township Advisory Board of Health was held for the purpose of completing the Local Board of Health Governance Performance Assessment Instrument.



After reading the survey, Deputy Mayor Zitone stated that he did not feel that the Boards were qualified to complete it. In his opinion, a majority of the questions dealt with matters that were handled by our enforcing agency, the County Board of Health.

Deputy Mayor Zitone made a motion to mark the survey as being rejected and return it.

Advisory Board of Health Member Reginald Cole seconded the motion.

The motion did not carry on a roll call vote:

The Committee and the Advisory Board of Health continued to work on the Governance until 7:55p.m. at which time it was decided to end this session with the Advisory Board of Health and to reconvene at 7:00 p.m. on October 28, 2003.



Committeeman Krebs made a motion to take a brief recess.

Board of Health Member Reginald Cole seconded the motion.

The motion was carried by a unanimous voice vote.





The Township Committee re-opened their meeting at 8:05p.m.



Approval of Minutes: September 23, 2003

Committeeman Butto made a motion to approve the minutes of the Regular Session of September 23, 2003.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous voice vote.



Ordinances:

First Reading:

Ord. 2003-22 An Ordinance to Amend Chapter 76 of the General Ordinances of the Township of Montague, Being the Zoning Chapter, for the Purpose of Amending Ordinance No. 2003-08 Removing the Three Acre Minimum Lot Sizes in the R-4 High Density Residential Zone District Within the Township

Committeeman Butto made a motion to adopt Ordinance 2003-22 on first reading.

Deputy Mayor Zitone seconded the motion.

The motion was carried by a unanimous roll call vote:

Committeeman Butto, Committeeman Krebs, Mayor Barbagallo

Second Reading:

Ord. 2003-21 An Ordinance to Amend Chapter 76 of the General Ordinance of the Township of Montague, Being the Zoning Chapter for the Purpose of Establishing an R- 4SC Zone-"Planned Adult Residential Community" Zone Within the Township

Deputy Mayor Zitone made a motion to adopt Ordinance 2003-21 on second reading.

Committeeman Krebs seconded the motion.



Committeeman Krebs made a motion to open the public hearing.

Committeeman Butto seconded the motion.

The motion was carried by a unanimous voice vote.



Public Hearing:

There was no public comment.



Committeeman Butto made a motion to close the public hearing.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous voice vote.



The motion to adopt Ord. 2003-21 was carried by a unanimous roll call vote:

Resolutions

R2003-85 Tax Sale Duplicate Certificate

Committeeman Krebs made a motion to adopt R2003-85.

Committeeman Butto seconded the motion.

The motion was approved by a unanimous voice vote.



Old Business

New Myrtle Drive, Bills Lane, Piney Road, Ridge Road-

Engineering Estimate

The Committee requested that the Clerk contact the Township engineer and ask him to prepare an estimate of the engineering cost for all of the above mentioned roads.



Window Installation-Court Administrator's Office

The Committee asked the Clerk to get a second estimate for the installation of a glass payment window for the Court Administrator's office.



Cell Tower

Stephen Edelstein, attorney, advised the Committee that he has been in contact with a representative of Crown Atlantic and he was told that they intend to go ahead with the building of the cell tower. Mr. Edelstein did not have all the details concerning the location or the start date. He will have more information at the next meeting.



New Business

Sample Fire Code Ordinance and Uniform Fire Code

The Committee tabled any action on the above referenced matter.



Proclamation - October as Disability Awareness Month

Mayor Butto read a proclamation declaring October as Disability Awareness month.

Deputy Mayor Zitone made a motion to adopt this proclamation.

Committeewoman Kaman seconded the motion.

The motion was carried by a unanimous voice vote.



Volunteer Fire Dept. - Certificate of Title - 1976 Mack

Committeewoman Kaman made a motion to accept ownership of the above referenced fire truck.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous voice vote.



Tax Search-Block 48, Lot 44 - Fox Hollow Road

The Committee discussed the discrepancy concerning the ownership of the above property. Because it was obviously a mistake made by the Township many years ago, the Committee decided the only way to clear it up was to have an independent title search done.

They asked Clerk Felter to arrange it.

Tax Collector's Report for September, 2003

Volunteer Fire Dept. Monthly Reports for August & Sept.,2003

The Committee noted receipt of the above referenced reports.



Approval of Vouchers - Payment of Bills:

Committeeman Krebs made a motion to approve payment of all vouchers.

Committeeman Butto seconded the motion.

The motion was carried by a unanimous voice vote.



Correspondence:

Library Services

The Committee noted receipt of the above referenced correspondence.



Public Participation

Deputy Mayor Zitone made a motion to open the floor to public participation.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous voice vote.



Dominic Iole

Mr. Iole asked the Committee if they had received the title search of New Myrtle Drive. The Committee replied that they had not but hoped to have more information at their next meeting.





Reginald Cole

Mr. Cole wanted to know if a piece of property was part of

"The Robert's farm". Mayor Barbagallo told him that there was a question of ownership and that the Committee has decided to have a title search done to clear up this problem.



Mayor Barbagallo asked if anyone else from the public wished to speak. There was no one.



Deputy Mayor Zitone made a motion to close public participation.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous voice vote.
