MONTAGUE TOWNSHIP COMMITTEE MEETING
February 25, 2003
Minutes
Mayor Barbagallo called the session to order at 7:15 p.m. and opened the meeting, stating that the meeting was being held in compliance with the Open Meetings Act, P>L> 1975, c. 231, and has been duly advertised.
The Clerk was asked to call the roll.
Present were: Committeewoman Kaman, Committeeman Butto, Committeeman Krebs, Mayor Barbagallo
Helen F. Felter, Clerk, Denis G. Murphy, Atty.
Absent: None
Excused: Deputy Mayor Zitone
All present were asked to join in the Pledge of Allegiance.
Committeeman Butto made a motion to convene an executive session.
Committeeman Krebs seconded the motion.
The motion was carried by a unanimous voice vote.
Mayor Barbagallo made a motion to re-open the regular session of the meeting.
Committeewoman Kaman seconded the motion.
The motion was carried by a unanimous voice vote.
Approval of Minutes:
Committeeman Butto made a motion to approve the minutes of the Regular Session February 11, 2003.
Committeeman Krebs seconded the motion.
The motion was carried by a unanimous voice vote.

Second Reading:
Ord. 2003-07 An Ordinance Re-zoning Block 17, Lot 1.03 Changing It From The Conservation District Zone (CD Zone) To The R-2 Low Density Residential Zone
Committeeman Butto made a motion to approve the above referenced ordinance.
Committeeman Krebs seconded the motion.
Public hearing:
Committeeman Krebs made a motion to open a public hearing regarding Ord. 2003-07.
Committeeman Butto seconded the motion.
The motion was carried by a unanimous voice vote.
There was no comment from the public.
Committeeman Krebs made a motion to close the public hearing.
Committeeman Butto seconded the motion.
The motion was carried by a unanimous voice vote.
The motion to adopt Ord. 2003-07 was carried by a unanimous roll call vote:

Second Reading:
Ord. 2003-08 An Ordinance To Amend Chapter 76 Of The General Ordinances Of The Township Of Montague, Being The Zoning Chapter For The Purpose Of Increasing The Minimum Lot Sizes In The Residential Zoning Districts, R-2 And R-3 Low Density Residential Zone Districts, The R-5 Medium Density Residential Zone District And The R-4 High Density Residential Zone District With The Township
Committeeman Butto made a motion to adopt Ord. 2003-08 and
R2003-29.
Denis Murphy, attorney for the Township read R2003-29 aloud for the information of the public.
Committeewoman Kaman seconded the motion.
Committeeman Krebs made a motion to open the public hearing.
Committeeman Butto seconded the motion.
The motion was carried by a unanimous voice vote.
Evelyn Mills
Ms. Mills asked the Committee if a subdivision application that went before the Land Use Board but was deemed not complete will be affected by the passing of this ordinance. Mayor Barbagallo advised Ms. Mills that the ordinance was going to be acted on tonight but that they still have the option of applying for a variance. Ms. Mills thanked the Committee for their time.
Steven Gallo
Mr. Gallo spoke to the Committee on behalf of his client who currently had an application to sub-divide a parcel of land. This application was deemed incomplete by the Land Use Board. This application later was deemed to be complete but not voted on. Mr. Gallo, because of these circumstances, requested that this application, and any other applications deemed complete at this time, be exempt from the conditions of Ordinance 2003-8 and R2003-29. Mayor Barbagallo advised Mr. Gallo to speak with the Land Use Board concerning this matter.
Darren Ponce
Mr. Ponce felt that it would be better if the Township went to five (5) acre zoning instead of three (3) acres. He felt this would be better for sceptics and for the water. Mayor Barbagallo stated that it is a possibility that in the future the zoning may be changed to five acre zoning. The Mayor said he agreed with Mr. Ponce in this matter.
Mayor Barbagallo asked if there was anyone else who wished to speak. There was no one.
The motion to adopt Ord.2003-08 and R2003-29 was carried by a roll call vote:

Resolutions

Committeeman Krebs made a motion to adopt the above referenced resolutions.
Committeeman Butto seconded the motion.
The motion was carried by a unanimous voice vote.
Old Business
Foreclosed Property-Evergreen Enterprises-Block 19.06, Lot 4
Committeewoman Kaman made a motion to accept the bid from Evergreen Enterprises for the above referenced foreclosed property.
The motion was seconded by Committeeman Butto.
The Motion was carried by a unanimous roll call vote:

It was also decided by the Committee that all remaining foreclosed properties will put up for sale at the next auction.
New Business
Minor Subdivision -Land Use Board - Sharon Yarosz, Secretary
A letter from the Land Use Board recommending that the definition of a "Minor Subdivision" in the Montague Township Ordinance book read "containing not more than three (3) lots..." It now states that a minor subdivision contains five (5) lots. The Committee agreed with this recommendation and asked Denis Murphy, attorney for the Township to write an ordinance stating the change.
Paul & Colleen Corujo-Subornation of Small Cities Mortgage
Committeewoman Kaman made a motion to allow the subornation of the Small Cities Mortgage.
Committeeman Butto seconded the motion.
The motion was carried by a roll call vote:

Approval of Vouchers - Payment of Bills:
Committeeman Butto made a motion to approve the bills.

Correspondence:
Borough of Point Pleasant Resolution No. 069-2003
The Committee decided to table any action on the above resolution until they have more information concerning the current movement to change the present property tax system.
Public Participation
Committeeman Butto made a motion to open public participation.
Committeeman Krebs seconded the motion.
The motion was carried by a unanimous voice vote.
Reginald Cole
Mr. Cole spoke to the Committee regarding the problems with the trucks at the Citco Gas Station on Route 23. When the trucks are fueled, they pull up to the edge of the exit which impairs the site distance for other traffic. Mayor Barbagallo said he was aware of the problem and that he would go to the station and talk to them about it. He also asked the Clerk to have Frank Walsh, the Zoning Officer, look into the problem.
Glen Goodyear
Mr. Goodyear spoke to the Committee concerning the recreation program. The Committee asked Mr. Goodyear to write up a schedule of programs the Recreation Committee would like to do and give it
to them. Mr. Goodyear said he would.
Evelyn Mills
Ms. Mills addressed the Committee concerning High Point Country Club. She explained that when the Community was first formed, it was for 55 Years and older. Then, after a length of time, families with children moved in. Ms. Mills suggested that the Committee research how the 55 years and older clause was enacted and perhaps apply it to the proposed new construction planned in the Country Club.
Mayor Barbagallo asked if anyone else in the public wished to speak. There was no one.
Committeeman Butto made a motion to close public participation.
Committeeman Krebs seconded the motion.
The motion was carried by a unanimous voice vote.
