MONTAGUE TOWNSHIP COMMITTEE MEETING

April 22, 2003

Minutes

Mayor Barbagallo called the session to order at 7:15 p.m. and opened the meeting, stating that the meeting was being held in compliance with the Open Meetings Act, P>L> 1975, c. 231, and has been duly advertised.

The Clerk was asked to call the roll.

Present were: Committeewoman Kaman, Deputy Mayor Zitone Committeeman Butto, Committeeman Krebs,

Mayor Barbagallo

Helen F. Felter, Clerk, Denis G. Murphy, Atty.

Absent: None

All present were asked to join in the Pledge of Allegiance.

Approval of Minutes:

Committeeman Butto made a motion to approve the minutes of the Regular Session 4-08-03 and the Executive Session of 4-08-03.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous roll call vote:

Ayes: Deputy Mayor Zitone, Committeeman Butto,

Committeeman Krebs, Mayor Barbagallo

Nays: None

Abstain: Committeewoman Kaman

Adoption of the 2003 Township of Montague Budget

Deputy Mayor Zitone made a motion to adopt the 2003 Township of Montague Budget.

Committeewoman Kaman seconded the motion.

Committeeman Krebs made a motion to open the public hearing.

Committeeman Butto seconded the motion.

The motion was carried by a unanimous voice vote.

There was no comment from the public

Committeeman Butto made a motion to close the public hearing.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous voice vote.

The motion to adopt the 2003 Township of Montague budget was carried by a unanimous voice vote:

Committeeman Butto, Committeeman Krebs, Mayor Barbagallo

Ord. 2003-13 Salary Ordinance

Committeeman Butto made a motion to approve the Salary Ordinance for 20003.

Deputy Mayor Zitone seconded the motion.

The motion was approved by a roll call vote:

Committeeman Butto, Committeeman Krebs, Mayor Barbagallo

First Reading:

Ord. 2003-14 Emergency Appropriations

Committeeman Butto made a motion to approve the above referenced ordinance.

Committeeman Krebs seconded the motion.

Second Reading:

Ord. 2003-09 An Ordinance Regulating the Statutory Authority of the United Telephone Company of New Jersey, Inc. to Use the Various Public Roads, Streets, and Highways and Other Public Ways in the Township of Montague for its Local and Through Lines and Other Communications

Deputy Mayor Zitone made a motion to adopt Ord. 2003-09

Committeeman Butto seconded the motion.

Ord. 2003-10 An Ordinance Revising the Definition of a "Minor Subdivision" Contained in Section 60-4 of the Code of the Township of Montague

Deputy Mayor Zitone made a motion to adopt the above referenced ordinance.

Committeewoman Kaman seconded the motion.

Ord. 2003-11 An Ordinance Abolishing the Industrial and Economic

Development Commission and Rescinding and Deleting Section 2-64, 2-65, 2-66, 2-66.1. 2-66.2 of the Code of the Township of Montague

Deputy Mayor Zitone made a motion to adopt Ord. 2003-11.

Committeeman Krebs seconded the motion.

The motion to adopt Ord. 2003-11 was carried by a roll call vote:

Resolutions

R2003-47 Refund of Erroneous Tax Payment-Blk. 1, Lot 28.03

R2003-48 Outside Lien Redemptions

Committeeman Butto made a motion to approve the above mentioned resolutions.

Committeeman Krebs seconded the motion.

The motion was approved by a unanimous voice vote.

R2003-49 Budget Adoption

Committeeman Butto made a motion to adopt R2003-49.

Deputy Mayor Zitone seconded the motion.

The motion was approved by a unanimous voice vote.

R2003-50 Dedication by Rider-Snow Removal

R2003-51 Dedication by Rider-Accumulated Absences

R2003-52 Dedication by Rider-Small Cities

Committeeman Butto made a motion to adopt all of the above referenced resolutions.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous voice vote.

Report:

Township of Montague Volunteer Fire Dept. Monthly Report for March, 2003

The Township Committee acknowledged receipt of the above referenced report.

Application

N.J. State Fireman's Association - Martin Ellicott

Committeewoman Kaman Made a motion to approve the above referenced application.

Committeeman Butto seconded the motion.

The motion was approved by a unanimous voice vote.l

Old Business

Fire Sub Code Official/Fire Official Appointment

Committeeman Butto made a motion to interview and hire at the present rate for the positions of Fire Sub Code Official/Fire Official.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous roll call vote:

Ayes: Committeewoman Kaman, Deputy Mayor Zitone,

Committeeman Butto, Committeeman Krebs, Mayor Barbagallo

New Business

Tri-State Chamber of Commerce-9th Annual Tri-State Classic 10K Race

Committeeman Krebs made a motion to permit the holding of the Tri-State Classic 10K race.

Committeeman Butto seconded the motion.

The motion was carried by a unanimous voice vote.

Dog Census

Deputy Mayor Zitone made a motion to approve the expenditure of $500.00 to have a dog census conducted.

Committeeman Butto seconded the motion.

The motion was carried by a unanimous roll call vote:

Committeeman Butto, Committeeman Krebs, Mayor Barbagallo

Nays: None

Resignation

The Committee noted receipt of correspondence from the DPW resigning from the recycling program.

Transfer of Ownership of Minisink Road to the Township of Montague

Committeeman Krebs made a motion that the Township accept ownership of Minisink Road.

Committeeman Butto seconded the motion.

The motion was carried by a unanimous roll call vote:

Committeeman Butto, Committeeman Krebs, Mayor Barbagallo

Approval of Vouchers - Payment of Bills:

Committeeman Krebs made a motion to pay all the bills.
