MONTAGUE TOWNSHIP COMMITTEE MEETING

July 8, 2003



Minutes





Mayor Barbagallo called the session to order at 8:05 p.m. and opened the meeting, stating that the meeting was being held in compliance with the Open Meetings Act, P>L> 1975, c. 231, and has been duly advertised.



All present were asked to join in the Pledge of Allegiance.



The Clerk was asked to call the roll.



Present were: Committeewoman Kaman, Deputy Mayor Zitone Committeeman Butto, Committeeman Krebs,

Mayor Barbagallo

Helen F. Felter, Clerk, Denis G. Murphy, Atty.

Absent: None



Mayor Barbagallo thanked Reginald Cole and Deborah Mulligan for their assistance in helping Desmond Finegan during the

Volunteer dinner.





Approval of Minutes:

Committeeman Butto made a motion to approve the minutes of the Regular Session of 5-27-03 and the Executive Sessions of 5-27-03 and 6-10-03.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous roll call vote:

Ayes: Committeewoman Kaman, Deputy Mayor Zitone,

Committeeman Butto, Committeeman Krebs, Mayor Barbagallo

Resolutions

R2003-63 Authorizing Cancellation of Township Certificates

R2003-64 Outside Lien Redemption

R2003-65 In Rem Foreclosures

R2003-66 Refund of Developers Escrow Deposit

R2003-67 Refund of 2003 Taxes

R2003-68 Renovation of High Point Monument

Committeeman Butto made a motion to adopt all of the above referenced resolutions.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous voice vote.



Old Business

Laddy Clark & Ryan-Altamont Development

The above noted correspondence from Laddy Clark & Ryan is in reference to a subdivision to be done by Altamont. They are requesting that the recent 3 acre zoning not apply to the R4 zone. In return for this stipulation, they will deed restrict

this development to age 55 or older. The Committee felt that

this agreement would be in the best interest of the Township.



New Business

Policy Regarding Cats-Helen Felter, Municipal Clerk

At the request of the Animal Control officer, Clerk Felter asked the Committee to clarify the Township's position on what constitutes a "pet cat." It was the opinion of the Committee that if a resident feeds a cat (outside or inside) it is a "pet" and becomes the responsibility of the resident.

Montague Fire Department Monthly Report for May, 2003

Tax Collector's Report of Revenues Collected for the Month of June, 2003

The Committee noted receipt of the above referenced reports.



Approval of Vouchers - Payment of Bills:



Correspondence:

Pike County Pa. Road Task Force meeting

Deputy Mayor Zitone will attend the above mentioned meeting.



Land Use Board Secretary Sharon Yarosz-Morris County Conservancy

The Committee noted receipt of the above mentioned correspondence.



State of New Jersey-Request for Noise Ordinance Waiver

Committeeman Krebs made a motion to grant the State's request for a noise waiver.

Committeewoman Kaman seconded the motion.

The motion was carried by a unanimous voice vote.



Public Participation

Committeeman Krebs made a motion to open the meeting to the public.

Committeeman Butto seconded the motion.

The motion was carried by a unanimous voice vote.



Reginald Cole

Mr. Cole advised the Committee that he had been run off the road by a 60' truck that had no escort. He asked that Clove Road have a sign posted not to allow trucks wider than 102".



Kevin Lodema

Mr. Lodema asked the Committee about an ordinance that is pending

that would prohibit building a house with more than two (2) bedrooms on less than 3/4 of an acre. It was the tentative opinion of the Committee that the ordinance had to many issues and therefore, will not be enacted. Mr. Lodima thanked them for taking the time to explain the situation to him.



Mayor Barbagallo asked if anyone else would like to speak. There was no one.

Deputy Mayor Zitone made a motion to adjourn the meeting.

Mayor Barbagallo seconded the motion.

The motion was carried by a unanimous voice vote.



The meeting adjourned at 9:10 p.m.
