MONTAGUE TOWNSHIP COMMITTEE MEETING

August 12, 2003



Minutes





Mayor Barbagallo called the session to order at 7:35 p.m. and opened the meeting, stating that the meeting was being held in compliance with the Open Meetings Act, P>L> 1975, c. 231, and has been duly advertised.



The Clerk was asked to call the roll.



Present were: Committeewoman Kaman, Deputy Mayor Zitone Committeeman Butto, Committeeman Krebs,

Mayor Barbagallo

Helen F. Felter, Clerk, Denis G. Murphy, Atty.

Absent: None



Committeeman Krebs made a motion to go into Executive Session.

Committeeman Zitone seconded the motion.

The motion was carried by a unanimous voice vote.



Committeeman Zitone made a motion to re-open the Regular Session.

Committeeman Butto seconded the motion.

The motion was carried by a unanimous voice vote.



All present were asked to join in the Pledge of Allegiance.



Franchise - Cablevision:

Public Hearing

Mr. Gary Shore of Cablevision addressed the Committee and the public regarding the plans Cablevision has to up-date their programing. He also explained how they were up-dating the present lines. The Committee had several questions and concerns which Mr. Shore answered. Several members of the public also had questions and concerns which Mr. Shore answered or promised to check into. Mr. Shore thanked the Committee for their time and asked them to contact him if they had anything further that he could be of assistance with.



Presentation:

Mr. John Bruno of the Bruno Group spoke to the Committee about what grants his Group was working on and requested that his contract with the Township be extended for an additional six (6) months. Mr. Bruno also stated that if at the end of that time no grant money was obtained, his firm would work without compensation until the Township did receive at least the amount of their contract, $90,000. After a lengthy discussion, the Committee agreed to the extension.



Deputy Mayor Zitone made a motion to approve an extension of the contract with the Bruno Group.

Committeeman Butto seconded the motion.

The motion was carried by a roll call vote:

Nay: Mayor Barbagallo



Approval of Minutes:

Committeeman Butto made a motion to approve the minutes of the Regular Session of 7-08-03,and the minutes of 6-10-03 were tabled.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous voice vote.



Ordinances:

First Reading:

Ord. 2003-20 An Ordinance to Amend Chapter 76 of the General Ordinance of the Township of Montague, Being the Zoning Chapter, for the Purpose of Reinstating the R-4 Zone Within the Township of Montague



Committeeman Butto made a motion to table Ord. 2003-20

Committeeman Krebs seconded the motion.

The motion was approved by a voice vote.



Second Reading:

Ord. 2003-12 An Ordinance Revising the Construction Fee schedule of the Township of Montague

Deputy Mayor Zitone made a motion to approve the above referenced ordinance.

Committeeman Krebs seconded the motion.



Committeeman Krebs made a motion to open the public hearing.

Deputy Mayor Zitone seconded the motion.

The motion was carried by a unanimous voice vote.



Public Hearing:

There was no comment from the public



Committeeman Krebs made a motion to close the public hearing.

Committeeman Butto seconded the motion.

The motion was carried by a unanimous voice vote.



Deputy Mayor Zitone's motion to adopt Ord. 2003-12 was carried by a unanimous roll call vote:

Second Reading:

Ord. 2003-15 An Ordinance Amending Ordinance 89-2 Entitled "An Ordinance of the Township of Montague to Regulate Excavations in Streets of the Township of Montague, County of Sussex, State of New Jersey

Deputy Mayor Zitone made a motion to adopt Ord. 2003-15

Committeeman Butto seconded the motion.



Committeeman Krebs made a motion to open the public hearing.

Deputy Mayor Zitone seconded the motion.

The motion was carried by a unanimous voice vote.

Public Hearing:

The motion to approve Ord. 2003-15 was approved by a unanimous

roll call vote:

Second Reading:

Ord. 2003-16 An Ordinance to Amend the Zoning Ordinance, Being Chapter 76 of the Consolidated Land Use Chapters of the Code of the Township of Montague, County of Sussex, State of New Jersey, to Restrict the Number of Bedrooms for New Residential Construction on Lots with an Area of Less Than 3/4 of an Acre.



Deputy Mayor Zitone made a motion NOT to approve Ord. 2003-16.

Committeeman Krebs seconded the motion.

The motion was approve by a unanimous voice vote.



Resolutions

R2003-69 Requesting Approval of Items of Revenue and Appropriation

R2003-70 Resolution Appointing the Fire Prevention Official- George Owen

R2003-71 Refund of Tax Duplicate

R2003-72 Authorization to Cancel Township Certificates

R2003-73 Multi-jurisdictional Small Cities Grant-Montague Township and Sandyston Township

R2003-74 Authorization to Cancel Erroneous Tax Assessment

R2003-76 Extension of Bruno Group Contract

Committeeman Krebs made a motion to approve the above noted resolutions.

Committeeman Butto seconded the motion.

The motion was carried by a unanimous voice vote.



Old Business

HLK Investment Corporation-Montague Lake

The Committee noted receipt of the above mentioned correspondence

stating that the property at Montague Lake will be cleaned up



New Business

Blue Ridge Rescue Squad

The Committee noted receipt of the correspondence from the

Blue Ridge Rescue Squad requesting an increase in their budget.



Serita Kleinman-6 Oak Ridge Road-Block 8, Lot 48

Ms. Kleinman sent a letter to the Committee donating her property in Montague Township to the Township.

Committeeman Butto made a motion to accept the donation of

Block 8, Lot 48 to the Township of Montague.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous roll call vote:

Ayes: Committeewoman Kaman, Deputy Mayor Zitone,

Committeeman Butto, Committeeman Krebs, Mayor Barbagallo

Nays: None

Denis Murphy, attorney for the Township, was asked to send a letter to Ms. Kleinman accepting the property on behalf of the Township.



Renewal Fee for Septic Permits-Fee for Perk Test Holes (mkaman)

Discussion on the above matter was tabled until a later date.



Gebhardt & Kiefer-Invoice for Legal Services

The Committee asked the Township attorney, Denis Murphy, to write a letter to have the above matter clarified.

Committeeman Krebs made a motion to table the above matter until more information could be obtained.

Mayor Barbagallo seconded the motion.

The motion was carried by a unanimous voice vote.



Approval of Vouchers - Payment of Bills:

Committeeman Krebs made a motion to pay all the bills.

Committeeman Butto seconded the motion.

The motion was carried by a unanimous voice vote.



Applications:

Application for Red Light Permit-Dale Bouma

Committeeman Krebs made a motion to approve the above mentioned application for a red light permit.

Committeewoman Kaman seconded the motion.

The motion was approved by a unanimous voice vote.



Application for Membership-Montague Fire Dept (as a firefighter)-

Richard H. Pond, Jr.

Committeewoman Kaman made a motion to approve the application of

Richard H. Pond, Jr.

Committeeman Krebs seconded the motion.

The motion was carried by a voice vote:

Ayes: Committeewoman Kaman, Deputy Mayor Zitone,

Committeeman Krebs, Mayor Barbagallo

Correspondence:

Dwight Fickes Fund-Dorothy Ames

Committeewoman Kaman advised the Committee that the event to raise money for the Dwight Fickes was very successful. The Committee thanked both Committeewoman Kaman and Ms. Ames for all the work they did to make this event a success.



Public Participation

Committeeman Butto made a motion to open the meeting to public participation.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous voice vote.



Reginald Cole

Mr. Cole spoke to the Committee concerning a noise ordinance.

He said that one of the businesses in Montague was creating so much noise on a recent week-end that he could hear it at his house which is one air mile away with a mountain in between. Another resident told Mr. Cole that he also heard the noise and his home is two mountains away. He went on to say that without a noise ordinance the State Troopers can't do anything. The Committee told Mr. Cole they would look into it.



Jim Neff

Mr. Neff asked the Committee about the suggested three acre zoning. He owns an 1½ acre piece of property and was concerned that he could not build on it. The Committee assured him that his property would be grandfathered. Mr. Neff thanked the Committee.



Richard Clauberg

Mr. Clauberg advised the Committee that he traveled down

Cadoo Road and found it to be almost impassable from the recent rain. The Committee thanked Mr. Clauberg for his concern and asked the Clerk to pass on the information to the DPW.



Mayor Barbagallo asked if there was anyone else who wished to speak. There was no one.



Deputy Mayor Zitone made a motion to close the public participation.

Committeewoman Kaman seconded the motion.

The motion was carried by a unanimous voice vote.
