MONTAGUE TOWNSHIP COMMITTEE MEETING
July 13, 2004
Minutes
Mayor Butto called the session to order at 8:10 p.m. and opened the meeting, stating that the meeting was being held in compliance with the Open Meetings Act, P>L> 1975, c. 231, and has been duly advertised.
The Clerk was asked to call the roll.
Present were: Committeeman Sarocco, Committeeman Zitone,
Deputy Mayor Barbagallo, Committeeman Krebs
Mayor Butto,
Atty. Murphy, Clerk Felter
Absent: None
All present were asked to join in the Pledge of Allegiance.
Presentation:
Mr. Gary Shaw on behalf of Cablevision Industries presented the Township with a defibrillator.
Approval of Minutes: Regular Session May 25, 2004
Committeeman Krebs made a motion to approve the minutes of the
May 25, 2004 meeting.
Deputy Mayor Barbagallo seconded the motion.
The motion was carried by a unanimous roll call vote:

First Reading:
Ord. 2004-09 An Ordinance to Abolish the Advisory Board of Health
Committeeman Zitone made a motion to approve on first reading
Ord. 2004-09.
Deputy Mayor Barbagallo seconded the motion.
The motion was passed by a unanimous roll call vote:

Second Reading:
Ord. 2004-08 An Ordinance Funding $192,000 for Acquisition of a Fire Truck and Backhoe
Deputy Mayor Barbagallo made a motion to adopt Ord. 2004-08.
Committeeman Krebs seconded the motion.
Deputy Mayor Barbagallo made a motion to open a Public Hearing.
Committeeman Soracco seconded the motion.
The motion was carried by a unanimous voice vote.
There was no comment from the public.
Deputy Mayor Barbagallo's motion to adopt Ord. 2004-08 was carried by a unanimous roll call vote:

R2004-45 A Resolution Ratifying And Accepting The Determination of the Residents of Piney Road, Bills Lane, Ridge Road
Committeeman Zitone made a motion to adopt R2004-45.
Committeeman Krebs seconded the motion.
The motion was carried by a unanimous roll call vote:

R2004-49 Cancellation of Tax Sale Premiums to Surplus

R2004-52 A Resolution to Support Volunteer Tuition Credit Program
Committeeman Soracco made a motion to adopt the above referenced resolutions.

R2004-53 A Resolution to Appoint a Deputy Clerk/Deputy Registrar
Deputy Mayor Barbagallo made a motion to adopt R2004-53.

R2004-54A A Resolution to Approve the Work on Birch Tree Road
Deputy Mayor Barbagallo made a motion to approve R2004-54A.
The motion was seconded by Committeeman Krebs.
The motion was approved by a unanimous roll call vote:

Old Business
Jack O'Krepky-State Aid 2005-Birch Tree Road
After a short discussion, the Township Committee directed the Municipal Clerk to write a letter to Mr. Jack O'Krepky authorizing him to proceed with the survey work on
Birch Tree Road at a cost of $4,320.00 for 3,400LF. R2004-54A
as passed above will be sent to Mr. O'Krepky when the finished draft is received.
Community Information Guide
The Committee asked the Clerk to proceed with the Community Information Guide.
Fran Multari, Tax Collector, Block 8, Lot 48 Deputy Mayor Barbagallo stated that he felt we should accept this property and forgive the taxes. Mayor Butto agreed as he felt if we do not we will only have to pay the foreclosure costs later.
Deputy Mayor Barbagallo made a motion to accept the donation to the Township of Block 8, Lot 48.
Committeeman Zitone seconded the motion.
The motion was carried by a unanimous roll call vote:

New Business
Recreation Committee
It was suggested that anyone that desires to be on the Recreation Committee meet with two members of the Township Committee to discuss what programs they wish to initiate etc.
Montague Department of Public Works-David Berhman
David Berhman, Foreman of the DPW requested permission to sell some equipment that they no longer have use for.
After a short discussion, the Committee agreed to the sale and requested the Clerk to advertise it.
R. Poust-Heating & Cooling
R. Poust, Inc. submitted a contract for the maintenance of the Township heating system and also the air conditioning system.
Committeeman Zitone made a motion to grant the contract to
R. Poust, Inc.
Deputy Mayor Barbagallo seconded the motion.
The motion was carried by a unanimous voice vote.
Clove Road Meeting:
Committeeman Zitone advised that on June 15th he and members of the Land Use Board attended a meeting concerning the repairs to be made to Clove Road. Committeeman Zitone said it was a very informative meeting. Another meeting will be scheduled in the near future.
Senior Citizens of the Year
Mr. Desmond Finegan, Senior Citizen Advocate and President of the Montague Senior Citizens advised the Committee that the seniors of Montague suggested that Helen Winters be nominated the Female Senior Citizen of 2004 and that Jessie Haynes be awarded the Male Senior Citizen of 2004. The Committee agreed with these nominations.

Deputy Mayor Barbagallo made a motion to approve the above referenced applications if Mr. Smith passes a physical examination.
Committeeman Krebs seconded the motion.

Tax Collector's Report Month of June, 2004
The Committee noted receipt of the above mentioned report.
Approval of Vouchers - Payment of Bills:
Committeeman Krebs made a motion to approve payment of the bills.
Committeeman Soracco seconded the motion.
The motion was carried by a unanimous voice vote.

Public Participation
Committeeman Soracco made a motion to open public participation.
Deputy Mayor Barbagallo seconded the motion.
The motion was carried by a unanimous voice vote.
Reginald Cole
Mr. Cole complained to the Committee that he could hear the bands playing at the Blackthorn Inn, after 11:00 p.m. where he lives. He felt something should be done about it.
Josephine Yarosz
Mrs. Yarosz thanked the Committee for listening to the wishes of the residents on Piney Road, Ridge Road and Bills Lane by not taking over the roads and not doing any reconstruction. She also mentioned that she did not hear any music from the Blackthorn Inn.
Lou Ann Cular
Ms. Cular asked the Committee if there was a resolution done for the reconstruction of New Myrtle Drive. She also asked that the Road Department put something on the road as it was almost impassable. Committeeman Zitone said he would go with the Road Foreman and see what could be done.
Mayor Butto asked if anyone else wished to speak? There was no one.
Committeeman Soracco made a motion to close public participation.
Committeeman Krebs seconded the motion.
The motion was carried by a unanimous voice vote.
