MONTAGUE TOWNSHIP COMMITTEE MEETING



September 14, 2004



Minutes





Mayor Butto called the session to order at 8:00p.m. and opened the meeting, stating that the meeting was being held in compliance with the Open Meetings Act, P>L> 1975, c. 231, and has been duly advertised.



The Clerk was asked to call the roll.



Present were: Committeeman Sarocco, Committeeman Zitone,

Deputy Mayor Barbagallo, Committeeman Krebs

Mayor Butto,

Atty. Murphy, Clerk Felter

Absent: None



All present were asked to join in the Pledge of Allegiance.

Second Reading:

Ord. 2004-10 An Ordinance Granting Municipal Consent For The Operation of a Cable System Within The Township of Montague, New Jersey to Cablevision of Warwick, LLC

Deputy Mayor Barbagallo made a motion to approve Ord. 2004-10.

Committeeman Krebs seconded the motion.



Public Hearing:

Deputy Mayor Barbagallo made a motion to open the public hearing.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous voice vote:



Desmond Finegan

Mr. Finegan advised the Committee that he had called the

Board of Public Utilities to complain of the numerous commercials. Mr. Finegan also advised the Committee that when he tried to pay his Cablevision bill at Bella's Pizza, they told him they could not take a check made out to Cablevision, it had to be cash. Mr. Gary Shaw, representative of Cablevision, promised he would look into this matter.



Ed Ibold

Mr. Ibold suggested that it might be good to have a drop box for checks to pay the Cablevision bills.



The Mayor asked if there were any other comments. There were none.



Deputy Mayor Barbagallo's motion to adopt Ord. 2004-10 passed on a roll call vote:

Ayes: Committeeman Soracco, Deputy Mayor Barbagallo,

Committeeman Krebs, Mayor Butto

Nays: None



Abstain: Committeeman Zitone



First Reading:

Ord. 2004-11 An Ordinance Authorizing the Reconstruction, Improvements, Assessment and Acceptance of New Myrtle Drive as a Township Road

Committeeman Zitone made a motion to approve Ord. 2004-11.

Deputy Mayor Barbagallo seconded the motion.

The motion was approved by a unanimous roll call vote:

Ayes: Committeeman Soracco, Committeeman Zitone,

Deputy Mayor Barbagallo, Committeeman Krebs, Mayor Butto

Resolutions

R2004-58 Outside Lien Redemption

R2004-59 Authorizing Cancellation of Township Certificates by Assignment

R2004-60 Rescind R2004-56 for Sale of Township Certificates by Assignment

R2004-61 Proposal for Sale of Township Certificate by Assignment

R2004-62 Refund of Tax Duplicate Payment

R2004-63 Refund of Erroneous Tax Payment

Deputy Mayor Barbagallo made a motion to approve the above reference resolutions.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous voice vote.



R2004-64 Audit Resolution

Deputy Mayor Barbagallo made a motion to adopt R2004-64.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous roll call vote:

R2004-65 Resolution of Foreclosure Action Taken Against a Property on Which The Township of Montague Holds a Mortgage

Deputy Mayor Barbagallo made a motion to adopt R2004-65.

Committeeman Soracco seconded the motion.

The motion was carried by a unanimous roll call vote:

Ayes: Committeeman Soracco, Committeeman Zitone,

Deputy Mayor Barbagallo, Committeeman Krebs, Mayor Butto

Old Business:

New Jersey State Health Benefits

Mayor Butto addressed a memo to the Committee concerning reimbursement of premiums paid for Health Care coverage. After a very lengthy discussion the request was tabled.

Committeeman Zitone made a motion to table any action regarding reimbursement of health care premiums.

The motion was seconded by Deputy Mayor Barbagallo.

The motion was carried by a roll call vote:

Ayes: Committeeman Soracco, Committeeman Zitone,

Deputy Mayor Barbagallo

Nays: None

Abstain: Committeeman Krebs, Mayor Butto



New Business



R-4SC Zone - Sharon Yarosz, Secretary for the Land Use Board

Mrs. Yarosz addressed a memo to the Committee advising them that the Land Use Board would like to have Ordinance 2003-21, the ordinance that establishes the R-4SC Zone more defined as to what properties are included.

Deputy Mayor Barbagallo made a motion to revise this ordinance.

Committeeman Krebs seconded the motion.

The motion passed by a unanimous roll call vote:

Ayes: Committeeman Soracco, Committeeman Zitone,

Deputy Mayor Barbagallo, Committeeman Krebs, Mayor Butto

The Committee noted receipt of the above referenced reports.



Approval of Vouchers - Payment of Bills:

Committeeman Zitone made a motion to approve payment of the bills.

Committeeman Soracco seconded the motion.

The motion was carried by a unanimous voice vote.



Correspondence:

Sussex County Municipal Utilities Authority-Wallkill River Watershed Group

The Committee noted receipt of the above referenced correspondence.



Victor Dai, Construction Official-Reappointment of Plumbing and Electrical Inspectors

Deputy Mayor Barbagallo made a motion to reappoint

Donald Stambough as Plumbing Inspector and Christopher Venezia as Electrical Inspector.

Committeeman Zitone seconded the motion.

The motion was carried by a unanimous roll call vote:

Ayes: Committeeman Soracco, Committeeman Zitone,

Deputy Mayor Barbagallo, Committeeman Krebs, Mayor Butto

Nays: None



Desmond Finegan-Closing of Montague Township Cablevision office

The Committee recognized receipt of the above referenced letter and stated they would look into it.



Public Participation

Committeeman Soracco made a motion to open the meeting to public participation.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous voice vote.





Desmond Finegan

Mr. Finegan addressed the Committee and stated that he is greatly disappointed in Cablevision. They are giving out defibrillators

and raising the rates. Mr. Finegan thanked the Committee for their time.



Keith Utter

Mr. Utter spoke to the Committee regarding the placing of signs at each end of Clove Road indicating that it's a high fatality roadway. Mr. Utter also asked that the Committee pass a resolution in support of Assembly Bill A710.



Joseph Lashendock

Mr. Lashendock advised the Committee that he had attended the last meeting concerning Clove Road. He explained to the Committee that there are several areas of the road that the County is planning to reconstruct.



Mayor Butto asked if anyone else wished to speak. There was no one.



Deputy Mayor Barbagallo made a motion to close public participation.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous voice vote.
