TOWNSHIP COMMITTEE MEETING
Minutes
DECEMBER 13, 2005
Mayor Barbagallo called the session to order at 8:00 p.m. and opened the meeting stating that the meeting was being held in compliance with the Open Meetings Act, P>L> 1975, c. 231 and has been duly advertised.
The Clerk was asked to call the roll.
Present were: Deputy Mayor Soracco, Committeeman Campana, Committeeman Lashendock, Committeeman Krebs, Mayor Barbagallo, Attorney Murphy, Clerk Francisco
Absent: None
All present were asked to join in the Pledge of Allegiance.
Approval of Minutes:
Committeeman Krebs made a motion to approve the minutes of November 9, 2005 and November 22, 2005 regular sessions.
Committeeman Lashendock seconded the motion.
The motion was carried by a unanimous voice vote.
Sealed Bid Opening of Equipment
The following bids were submitted:
Massey Ferguson Tractor- $325.50 , 1967 Stone Spreader $51.50, Davey Air Compressor $55.00
The above sealed bids were submitted by Darren Ponce.
1985 Chevrolet Ambulance, $569.99, Massey Ferguson Tractor $100.00
The above sealed bids were submitted by Mark Fasolo.
Massey Ferguson Tractor $675.00, 1967 Stone Spreader (2) $200.00, 1985 International Dump Truck $1000.00.
The above sealed bids were submitted by Kim Shaffert.

The above sealed bids were submitted by Beemerville Auto Wreckers.
Committeeman Lashendock made a motion to award the equipment to the highest bidder of each piece of equipment.
Deputy Mayor Soracco seconded the motion.
The Motion was carried by unanimous voice vote.
RESOLUTIONS:
R2005-94 OUTSIDE LIEN REDEMPTION
R2005-95 TRANSFER RESOLUTION
Deputy Mayor Soracco made a motion to adopt the above mention resolutions.
Committeeman Lashendock seconded the motion.
The motion was carried by a unanimous voice vote to adopt R2005-94 OUTSIDE LIEN REDEMPTION and R2005-95 TRANSFER RESOLUTION
ORDINANCES: First Reading
ORD 2005-27 AN ORDINANCE TO AMEND THE ZONING ORDINANCE, BEING CHAPTER 76 OF THE CONSOLIDATED LAND USE CHAPTERS OF THE CODE OF THE TOWNSHIP OF MONTAGUE, COUNTY OF SUSSEX, AND STATE OF NEW JERSEY, TO REPLACE AND CREATE CERTAIN ZONING CLASSIFICATIONS, AND PROVIDE STANDARDS THEREFOR
Committeeman Lashendock made a motion to table the above referenced ordinance.
Deputy Mayor Soracco seconded the motion.
The motion was tabled by unanimous roll call vote.
ORDINANCES: second reading
ORD 2005-2 4 AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 17 OF THE CODE OF THE TOWNSHIP OF MONTAGUE AND ENTITLING SAME "TOWNSHIP ADMINISTRATOR".
Deputy Mayor Soracco made a motion to open to the public.
Committeeman Lashendock seconded the motion.
The motion was carried by unanimous roll call vote.
Public:
Reginald Cole asked what was being amended, Mayor Barbagallo responded that the committee was amending the Clerk Title to Clerk/Administrator Title. Mr Cole commented that along with increased authority should be entitled to increase in pay.
Committeeman Krebs made a motion to close the public portion.
Committeeman Lashendock seconded the motion.
The motion was carried by unanimous roll call vote.

ORD 2005-25 AN ORDINANCE TO AMEND CHAPTER 76 OF THE GENERAL ORDINANCE OF THE TOWNSHIP OF MONTAGUE BEING THE ZONING CHAPTER (EXPIRATION OF ZONING PERMITS)
Deputy Mayor Soracco made a motion to open to the public.
Committeeman Lashendock seconded the motion.
The motion was carried by a unanimous voice vote.

Committeeman Krebs made a motion to close public portion.
Committeeman Lashendock seconded the motion.
The motion was carried by unanimous voice vote.

Ord 2005-26 AN ORDIANCE TO AMEND CHAPTER 76 OF THE GENERAL ORDINANCE
OF THE TOWNSHIP OF MONTAGUE, BEING THE ZONING CHAPTER (EXPIRATION OF VARIANCES)
Deputy Mayor Soracco made a motion to open to the public.
Committeeman Lashendock seconded the motion.
The motion was carried by unanimous voice vote.
Reginald Cole inquired regarding time frame of variances and Attorney Murphy clarified the time frame as 3 years, no other public comment was made.

Committeeman Krebs seconded the motion.
The motion was carried by unanimous voice vote.
Committeeman Krebs made a motion to adopt the above referenced ordinance.
Committeeman Lashendock seconded the motion.
The motion was carried by unanimous roll call vote.
NEW BUSINESS:
Fire Department application was submitted by John Babula.
Committeeman Krebs made a motion to approve the Volunteer Fire Department Application.
Committeeman Soracco seconded the motion.
The motion was carried by a unanimous voice vote.
Volunteer Award for Emmy Masset.
Committeeman Krebs made a motion to table the presentation of the award until Ms Masset was present to accept.
Committeeman Lashendock seconded the motion.
The motion was tabled.
REPORTS: TAX AND SMALL CITIES
APPROVAL OF VOUCHERS: Committeeman Krebs made a motion to approve the vouchers.
Committeeman Lashendock seconded the motion.
The motion was carried by a unanimous roll call vote.
CORRESPONDENCE:
Fire Sub-code Official Retirement Letter.
Blue Ridge Rescue Squad Contributions request for 2006.
Tax Lien Sale Canceled (2004 taxes paid)
Public Participation:
Deputy Mayor Soracco made a motion to open the Public Participation Session.
Committeeman Krebs seconded the motion.
Ms Ruth Owen president of the Montague Seniors spoke on behalf of the Montague Seniors
regarding the positions of Senior Advocate and Senior Financial Coordinator. She explained that the positions are duplicating work already being performed under the Bi-Laws of the Montague Seniors and is causing controversy and conflict.
Mr Henry Zeuw thanked the Committee each and everyone especially Mr. Campana and Mayor Barbagallo for their service to the Township and Community and extended his services whenever needed.
Mr Richard Wingle spoke regarding his road which is owned by High Point Community Corp and is part of the Armstrong Tract and has been brought up to meet state standards and request the township to take over road as soon as the right of way is deeded to township. The Mayor commented that the attorneys need to look onto the deed and a resolution would need to be adopted by the Township Committee when ready.

Mr Desmond Finegan spoke, and suggested that the Committee refer back to1998 regarding the positions of Senior Advocate and Senior Financial Coordinator and felt it was in the best interest of the Town.
Ms Ruth Owen addressed the Committee again regarding the Seniors and that the Treasurer is the overseer of the finance of the seniors according to their bi-laws.
Committeeman Krebs made a motion to eliminate the Senior Advocate and Senior Financial Coordinator and remove the positions from the 2006 Reorganization.
Deputy Mayor Soracco seconded the motion.
The Motion was carried by a roll call vote.
Vote: Ayes : Deputy Mayor Soracco, Committeeman Campana, Committeeman Krebs, Mayor Barbagallo.
Nays: Committeeman Lashendock
Deputy Mayor Soracco made a motion to close public session.
Committeeman Krebs seconded the motion.
The motion was carried by a unanimous roll call vote.
Committeeman Lashendock made motion to add two bays to the DPW building to temporarily house the Fire Department's needs.
The motion was withdrawn by Committeeman Lashendock.
Committeeman Krebs made a motion to discuss with an architect and engineer proposals for services to add on two bays to the DPW building.
Deputy Mayor Soracco seconded the motion.
The motion was carried by a roll call vote.
Vote: Ayes: Deputy Mayor Soracco, Committeeman Campana, Committeeman Lashendock, Committeeman Krebs.
Nays: Mayor Barbagallo
Committeeman Lashendock made a motion to adjourn meeting.
Committeeman Krebs seconded the motion.
The motion was carried by a unanimous voice vote.
Meeting was adjourned at 8:52 p.m.
