MONTAGUE TOWNSHIP COMMITTEE MEETING

April 26, 2005



Minutes





Mayor Barbagallo called the session to order at 8:00 p.m. and opened the meeting, stating that the meeting was being held in compliance with the Open Meetings Act, P>L> 1975, c. 231, and has been duly advertised.



The Clerk was asked to call the roll.



Present were: Committeeman Soracco, Mayor Barbagallo, Committeeman Krebs, Committeeman Lashendock

Atty. Murphy, Clerk Felter

Absent: None

Excused: Committeeman Zitone





All present were asked to join in the Pledge of Allegiance.



Approval of Minutes : March 08,2005 with corrections and April 12, 2005

Committeeman Krebs made a motion to approve minutes.

Committeeman Soracco seconded the motion.

The motion was carried by a unanimous voice vote.



R-2005-34 Adoption of Municipal Budget

Committeeman Krebs made a motion to adopt resolution R05-34

Committeeman Soracco seconded the motion.

The motion was carried by unanimous voice vote.

Committeeman Soracco made a motion to open public hearing.

Mayor Barbagallo seconded the motion.

The motion was carried by a unanimous voice vote.



Reginald Cole inquired how much the tax rate had increased and Tom Ferry, auditor responded that the municipal tax rate had not increased but decreased by 1%.

Ord. 2005-07 Salary Ordinance

Committeeman Soracco made a motion to adopt Ord. 2005-07.

Committeeman Lashendock seconded the motion.

The motion was carried by a unanimous voice vote.



Public Hearing:

Committeeman Soracco made a motion to open hearing to the public

committeeman Krebs seconded the motion

The motion was carried by a unanimous voice vote.



There was no public comment

Mayor Barbagallo motioned to close public hearing

Committeeman Lashendock seconded the motion

The motion was carried by unanimous voice vote.

Ord. 2005-08 An ordinance to Exceed the Municipal Budget Appropriation Limits and to Establish a Cap Bank

Committeeman Soracco made a motion to adopt ordinance 2005-08.

Committeeman Lashendock seconded the motion.

The motion was carried by a unanimous voice vote.

Ord. 2005-09 Ordinance to Amend and Supplement Chapter 55-Site Plan Review

Committeeman Lashendock made a motion to Adopt Ord. 2005-09

Committeeman Soroacco seconded the motion.

The motion was carried by a unanimous voice vote.

Committeeman Soracco made a motion to Open to public hearing

Committeeman Krebs seconded the motion

Ord. 2005-10 Ordinance to Amend and Supplement Chapter 57-Soil Erosion

Committeeman Lashendock made a motion to adopt ordinance 2005-10.

Committeeman Soracco seconded the motion.

The motion was carried by unanimous voice vote.

Committeeman Soracco made a motion to open to public hearing

Committeeman Krebs seconded the motion

The motion was carried by a unanimous voice vote.



Reginald Cole from the audience asked what was being changed with regard to the state ordinance and attorney Denis Murphy stated we were amending the municipal ordinance to comply with state statute.

No further comments from the audience.



Committeeman Soracco made a motion to close the public hearing.

Committeeman Lashendock seconded the motion.

The motion was carried by a unanimous voice vote.

Ord. 2005-11 Ordinance to Amend and Supplement Chapter 60-Subdivision Land

Committeeman Soracco made a motion to adopt Ord.2005-11.

Committeeman Lashendock seconded the motion.

The motion was carried by a unanimous voice vote.



Committeeman Soracco made a motion to open to public hearing.

Committeeman Lashendock seconded the motion.

The motion was carried by a unanimous voice vote.

Resolutions

R2005 -29 Outside Lien Redemption

Committeeman Krebs made a motion to adopt the above referenced resolution .

Committeeman Lashendock seconded the motion.

The motion was carried by unanimous voice vote.



R2005-30 Township Assumes the Responsibility of Conducting the Annual Budget Examination

Committeeman Krebs made motion to adopt the above referenced resolution .

Committeeman Soracco seconded the motion.

The motion was carried by a unanimous voice vote.



R2005-36A Appointment of Diana Francisco to Municipal Clerk position.



Committeeman Lashendock made motion to adopt the above referenced resolution.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous voice vote.



R2005-37A Appointment of Tina Sugar to the position of Court Administrator

Committeeman Soracco made a motion to adopt the above referenced resolution.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous voice vote.



R2005-38A New applicants with lots with Unimproved Roadway shall submit a $30,000 bond

Committeeman Soracco made a motion to adopt the above referenced resolution.

Committeeman Lashendock seconded the motion

Old Business





-Christopher Justice Block 16.06-Lot 6 tabled until next meeting

-Frances DeVizia Block 18.56.8 &18.56.9



Discussion ensued for the need for public sale, minimum bids and deed restrictions with regard to above properties, and the nine other non-perk properties which were returned to township. Denis Murphy, township attorney to research and advise committee at a later date.

Committeeman Krebs motion to table

Committeeman Lashendock seconded the motion.

The motion was tabled by a unanimous voice vote.

-Volunteer Background Checks-JL: Tabled for next meeting.

Committeeman Barbagallo made to motion to open discussion public

to the public.

A lengthy discussion took place with regard to the volunteer

background checks and the recreation committee.



Health Insurance (tabled from meeting of 3-22-05)

The committee requested a workshop next meeting in executive session.

Report acknowledged by mayor and committee





Correspondence

Letter was acknowledged thanking the volunteer fire department for their assistance regarding the flood from Nina Monahan president of Old Mine Road Commons Homeowners Association .

-Committeeman Soracco mentioned April 16,2005 Montague School fair was very successful.



Public Participation



Committeeman Lashendock made a motion to open public participation.

Committeeman Soracco seconded the motion



Mayor Barbagallo asked if there was anyone present who wished to speak.

Discussion regarding the Recreating a Recreation Committee with Rhodi Teufert and Fred Drake and other interested residents.

Recreation Committee names to be submitted to township.

Montague Day Clean Communities tentative date of July 9,2005.

Desmond Finigan spoke with regard to Cable Vision and the lack of Cable franchise choices.

Committeeman Lashendock made a motion to close public participation.

Committeeman Krebs seconded the motion.

The motion was carried by a unanimous voice vote.
