MONTAGUE TOWNSHIP COMMITTEE MEETING

August 23, 2005

MINUTES



Mayor Barbagallo called the session to order at 8:00 p.m. and opened the meeting, stating that the meeting was being held in compliance with the Open Meetings Act, P>L>1975,c.231, and has been duly advertised.



The Clerk was asked to call the roll.



Present were: Deputy Mayor Soracco, Committeeman Campana, , Committeeman Lashendock,

Committeeman Krebs, Mayor Barbagallo, Attorney Murphy, Clerk Francisco.



Absent: None



All present were asked to join in the Pledge of Allegiance.



Mr Desmond Finegan requested that he be able to record the meeting on his own tape recorder.

Mayor Barbagallo replied that he can record the meeting.



Approval of Minutes: Regular Session and Executive Session July 26, 2005. Amended March 22, 2005 minutes.

Committeeman Lashendock made a motion to approve minutes.

Committeeman Krebs seconded the motion.

The motion was carried by unanimous voice vote.



Ordinances: First Reading

Ord. 2005 -12 Fee Ordinance

Committeeman Lashendock made a motion to adopt above referenced ordinance.

Committeeman Krebs seconded the motion.

The motion was carried by unanimous roll call vote.



Ord. 2005-16 Alarm Devices

Committeeman Krebs made a motion to adopt the above referenced ordinance.

Committeeman Lashendock seconded the motion.

The motion was carried by unanimous roll call vote.



Ord. 2005-17 Criminal Background Checks

Committeeman Sorraco made a motion to adopt the above referenced ordinance with a change to exception section 33-6. adding or the background check is deemed unnecessary if volunteer is never going to be alone with a child to do background check on everyone.

Committeeman Lashendock seconded the motion.

The motion was carried by unanimous roll call vote.



Ord. 2005-18 Appropriation of Funds For the Purchase of Various Capital Projects

Committeeman Soracco made a motion to adopt the above referenced ordinance.

Committeeman Lashendock seconded the motion.

Motion was carried by unanimous voice vote.

Ord. 2005-14 Spending Ordinance for Fire Truck Tanker

Committeeman Soracco made a motion to adopt the above referenced ordinance.

Committeeman Krebs seconded the motion.

The motion was carried by unanimous voice vote.

Committeeman Lashendock made a motion to open to the public.

Desmond Finegan from the public asked where was the fire truck going to go? Mayor Barbagallo replied that the Fire Department has arranged to move certain vehicles around temporarily until a new fire house is built.

No further comment was made .

Committeeman Krebs seconded the motion to close public.

Motion was made to adopt the above referenced ordinance.

Motion was carried by unanimous roll call vote.

Ord. 2005-15 Capital Improvements for Repair and Resurfacing of Roads.

Committeeman Lashendock made a motion to adopt the above referenced ordinance.

Committeeman Soracco seconded the motion.

The motion was carried by a unanimous roll call vote.

Committeeman Lashendock made a motion to adopt the above referenced resolution.

R2005-66 Outside Lien Redemption

Committeeman Lashendock made a motion to adopt the above referenced resolution.

R2005-67 Emergency Appropriation of Funds for Fuel Costs

Committeeman Lashendock made a motion to adopt the above referenced resolution.

R2005-68 Payment of Outside Lien Redemption

Committeeman Lashendock made a motion to adopt the above referenced resolution

R2005-69 Authorizing Settlement of Litigation Involving Joseph Butto

Committeeman Soracco made a motion to adopt above referenced resolution.

Committeeman Krebs second the motion

Motion was carried by unanimous voice vote.



New Business

Fire House

Mayor requested the Committee authorization to continue with project and to gather bid packages information.

Committeeman Soracco made a motion to authorize the project.

Committeeman Lashendock seconded the motion.

Motion was carried by unanimous voice vote.



State Department of Agriculture Gypsy Moth Egg Masses Survey

Committee agreed to have the State Department do a Gypsy Moth Egg Masses Survey.

Committeeman Soracco made a motion to have survey done.

Committeeman Krebs seconded the motion.

Motion was carried by unanimous voice vote.



Volunteer Fire Department Application

Approval of Ron Smith's Fire Department application.

Fire Department Ladies Auxiliary Social Affair Permit

Committeeman Krebs made a motion to approve the applications.

Committeeman Lashendock seconded the motion.

Motion was carried by unanimous voice vote.



Old Business

Correction to Resolution2005-42 to state" Desmond Finegan" as Recycling Coordinator.



Reports

Committeeman Krebs made a motion to accept the monthly reports

Committeeman Lashendock seconded the motion.

Motion was carried by unanimous voice vote.

Recreation Committee reported that they have sent out news letters regarding activities for the Fall.



Correspondence

Mrs Bloom requested a 15 mile per hour designated speed limit at 6 Fox Hollow Rd.

After some discussion Mayor Barbagallo requested that the Township Committee inform Mrs Bloom that the Township has rejected the request.



Letter of resignation from Construction Secretary Kathleen Dai

Committeeman Lashendock made a motion to accept employees resignation..

Committeeman Krebs seconded the motion with regret.

Motion was carried by unanimous voice vote.



Lakeview Liquors LLC license approval.

Committeeman Lashendock made a motion to approve liquor license.

Deputy Mayor Soracco seconded the motion.

Motion was carried by unanimous voice vote.



Annual League of Municipalities

Tax Dept and Registrar attending Conference.

Committeeman Soracco made a motion to table discussion.

Committeeman Krebs seconded the motion. The motion was tabled.

Stormwater Management Correspondence

Need permit to wash Fire Trucks Approval of Vouchers

Committeeman Lashendock made a motion to approve vouchers.

Committeeman Krebs seconded the motion.

Motion was carried by unanimous voice vote.



PUBLIC PARTICIPATION

Deputy Mayor Soracco made a motion to open Public Session.

Committeeman Krebs seconded the motion

Motion was carried by unanimous voice vote.

Mayor Barbagallo asked if anyone would like to speak.



Mr Henry Zeuw took the floor and addressed the Committee and audience about volunteering and it's importance to the community and the concept of Volunteerism. He expressed his feelings with a heavy heart that the work he and his wife had done on Red Hill Rd had not been approved by the Clean Communities Coordinator. He informed the Mayor and Committee that he received a telephone call form the N.J. Veteran's Affair's Office and that charges had been leveled against him and the town and that a Veteran had been dishonored . He read the letter aloud which had been written by Desmond Finegan to Senator Corzine and expressed his feelings regarding the Memorial Day Program and made some suggestions regarding the appointment of Mr Finegan.

Mayor Barbagallo thanked him for his involvement in the Memorial Day Program and his time.



Mr Desmond Finegan took the floor and addressed the Committee in response to Mr Zeuw's comments. He expressed that he wished to refute Mr Zeuw's comments. Mr Finegan mentioned a voucher that was submitted to Clean Communities by Mr Zeuw for work done.



Mayor Barbagallo informed Mr Finegan that he would receive a letter in the morning from the Township stating that any business that he needed to conduct with the Township be done through Committeeman Lashendock and not done through individual departments within the Township Building.



Dorothy Ames took the floor commented on the good work done on Red Hill Rd by the Zeuw's.

Mayor Barbagallo asked if anyone else wanted to speak.

No response from the public.



Committeeman Lashendock made a motion to close public participation.

Deputy Mayor Soracco seconded the motion.

Motion was carried by unanimous voice vote.



Committeeman Krebs made a motion to close the meeting.

Committeeman Lashendock seconded the motion.

Motion was carried buy unanimous voice vote.

Meeting was adjourned at 9:07 p.m.
