MONTAGUE TOWNSHIP COMMITTEE MEETING

MINUTES

SEPTEMBER 13, 2005

Mayor Barbagallo called the session to order at 7:04 p.m and opened the meeting, stating that the meeting was being held in compliance with the Open Public Act, Chapter 231, of the Laws of 1975, has been duly advertised.



Committeeman Krebs made a motion to go into Executive Session to discuss

Deputy Mayor Soracco seconded the motion.

Motion was carried by a unanimous voice vote.

Minutes from the executive session may or may not be available to the public as per Committee

discretion.



Regular session convened at after a short break at 8:23 p.m.

The Clerk was asked to call the roll.

Present were Deputy Mayor Soracco, Committeeman Campana, Committeeman Lashendock, Committeeman Krebs, Mayor Barbagallo, Attorney Denis Murphy and Clerk Francisco.

Committeeman Krebs made a motion to adopt the above referenced ordinance on second reading

Deputy Mayor Soracco made a motion to adopt the referenced ordinance on second reading.

Committeeman Krebs seconded the motion.

Committeeman Krebs made a motion to approve all of the above referenced resolutions.

Deputy Mayor Soracco seconded the motion.

Motion was carried by unanimous roll call vote.



R2005-75 Reconstruction of New Myrtle Road

Deputy Mayor Soracco made a motion to approve the above referenced resolution.

Committeeman Krebs seconded the motion.

Motion was carried by unanimous roll call vote.



New Business

Municipal Audit Report

Committeeman Krebs made motion to table the introduction of the Municipal Audit Report so that a correction could be made on page 44 with the auditor.

Mayor Barbagallo seconded the motion.

Motion was tabled until next meeting.



Old Business

League Of Municipalities

Committeeman Krebs made a motion to approve employee participation at the League Conference for continuing education credits.

Deputy Mayor Soracco seconded the motion.

Motion was carried by a unanimous voice vote.



Approval of Vouchers:

Committeeman Krebs made a motion to accept payment of vouchers with the exception of the "Vital" bill, for inquiry.

Deputy Mayor Soracco seconded the motion.

Motion was carried by unanimous voice vote.

Board of Health

False Alarm Report

Recreation- Montague Day October 8, 2005 lay out of plan and schedule of events.

Zoning

Tax

Committeeman Lashendock made a motion to accept the above monthly reports.

Committeeman Krebs seconded the motion.

Motion was carried by unanimous voice vote.



Correspondence

KSM objectional PVC Pipes

Committeeman Lashendock made motion to accept correspondence and to prepare resolution and write a letter to the County Board of Health.

Committeeman Krebs seconded the motion.

Motion was carried by a unanimous voice vote.



Fence ordinance for a 5' fence however the standard fence size purchasable is 4'or 6'.

Committee recommends that the Land Use Board review the ordinance and advise the Committee for change.



State Health Benefits Program

Mayor Barbagallo made a motion to stay with the current State Health Benefit Program and to review it every 6 months, and the attorney to prepare a resolution rescinding R2005-62.

Committeeman Lashendock seconded the motion.

Motion was carried by a unanimous roll call vote with Committeeman Krebs abstaining.



Public Participation

Committeeman Lashendock made a motion to open to the public for participation.

Deputy Mayor Soracco seconded the motion.

Motion was carried by a unanimous voice vote.



PUBLIC

Henry Zeuw recommended that the Land Use Board and the Township attorney look at Legislature to make every fence constructed in Montague comply (except Agricultural Fences)

Local Ordinances preexisting and new.



David Coss from the Fire Department inquired about progress on the development of the new Fire House. Mayor Barbagallo responded with the fact that he is meeting with an engineer the upcoming Thursday. Also working on a bid package.

Rhodi Teufert commented on the numbers of books in the library and would like more space (such as the room behind the library) for the children's collection of books. Mayor Barbagallo responded that they could use that room she referred to as soon as the records that are in there now are managed.



Reginald Cole commented that the PVC pipes referred to earlier should be capped and commented on the space that he thought was available downstairs. He also commented on the need for a new fire house and the type of fire house. He also stated that the Mayor should stop picking on Mr Finegan.



Committeeman Krebs made a motion to close public session.

Committeeman Lashendock seconded the motion.

Motion was carried by unanimous voice vote.



Board of Health

Committeeman Lashendock made a motion to reinstate an advisory Board of Health and a resolution to be prepared for next meeting.

Committeman Krebs second the motion.

Motion was carried by a unanimous roll call vote.

Motion was carried by unanimous voice vote.
