MONTAGUE TOWNSHIP MAYOR AND COMMITTEE September 27, 2005



MINUTES

Mayor Barbagallo called the session to order at 7:08 a.m. and opened the meeting, stating that the meeting was being held in compliance with the Open Public Act, Chapter 231, of the Laws of 1975 and has been duly advertised.



Committeeman Krebs made a motion to go into Executive Session to discuss Personnel Matters. Deputy Mayor Soracco seconded the motion.

Motion was carried by unanimous voice vote.

Minutes from the executive session may or may not be available to the public as per Committee's discretion.



Regular session convened after a short break at 8:25p.m.



All present were asked to join in the pledge of allegiance.



The clerk was asked to call the roll.

Present were Deputy Mayor Soracco, Committeeman Lashendock, Committeeman Krebs,

Mayor Barbagallo, Attorney Denis Murphy and Clerk Francisco.



Excused: William Campana



Approval of Minutes: Regular and Executive Session Minutes of 08-23-05.



Ordinances: first readings

Ord 2005-19 Ordinance amending Ord 2005-07 Salary Ordinance

Committeeman Krebs made motion to adopt the above referenced ordinance.

Committeeman Lashendock seconded the motion.

Motion was carried by unanimous voice vote.



Ord 2005-20 Building/Construction Permit Fee Changes

Committeeman Lashendock made a motion to adopt the above referenced ordinance.

Deputy Mayor Soracco seconded the motion.

Motion was carried by unanimous roll call vote.



Resolutions:

R 2005-76 Emergency Appropriation for Electricity

R 2005-77 Outside Lien Redemption

R 2005-78 Refund Duplicate Tax Payment

Deputy Mayor Soracco made a motion to pass the above stated resolutions.

Committeeman Krebs seconded the motion.

The motion was carried by unanimous voice vote.



R 2005-79 Rescind Resolution 2005-62

Committeeman Lashendock made a motion to adopt the above stated resolution.

Deputy Mayor Soracco seconded the motion

Ayes: Mayor Barbagallo, Deputy Mayor Soracco, Committeeman Lashendock

Nayes: 0

abstain: Committeeman Krebs



R 2005-80 Refund of Tax Payments to First American Real Estate Tax Service

R 2006-81 Refund of Duplicate Payments To Homeowners.



Committeeman Soracco made a motion to adopt the above referenced resolutions..

Committeeman Lashendock seconded the motion.

Motion was carried by unanimous voice vote.





New Business

A modified sketch for the Township of Montague sign was presented.

Deputy Mayor Soracco made a motion to table discussion for further information.

Committeeman Krebs seconded the motion.

Motion was tabled by a unanimous voice vote.

Committeeman Soracco made a motion to change the regular meeting of November 8, 2005 to November 9th 2005 due to election day.

Committeeman Krebs seconded the motion.

Motion was carried by unanimous voice vote.



Old Business

Committeeman Krebs made a motion approve the Corrective Action Plan to the Municpal Audit

Deputy Mayor Soracco seconded the motion.

Motion was carried by unanimous voice vote.



The Township's Engineer Jack Okrepky requested that the Township Committee extend the bid date opening for New Myrtle Drive to November 22, 2005.

Committeeman Lashendock made a motion to extend the bid date.

Deputy Mayor Soracco seconded the motion.

Motion was carried by a unanimous voice vote.



COAH appropriation for the Town Planner

Committeeman Krebs made a motion to approve the appropriation to the Town Planner.

Committeeman Lashendock seconded the motion.

Motion was carried by unanimous voice vote.

Impact Fees were briefly discussed, no action was taken on Impact Fees.

Approval of Vouchers

Committeeman Krebs made a motion to pay Vouchers

Committeeman Lashendock seconded the motion.

Motion was carried by unanimous voice vote.



Reports

Small Cities Report

Monthly report was noted.



Correspondence

Letter from Mark Fasolo requesting the town to sell 2 pieces of equipment to him.

Committeeman Lashendock made a motion to respond to requestor that the town will hold another auction.

Committeeman Krebs seconded the motion.

Motion was carried by a unanimous voice vote.



Dispatching Contract

Committeeman Lashendock made a motion to table the Dispatching Contract until the Committee can compare with other towns.

Deputy Mayor Sorraco seconded the motion.

Motion was tabled.

Mayor Barbagallo commended The Recreation Committee regarding the fine job that was done on the newsletter.

Public Participation:

Committeeman Lashendock made a motion to open public session.

Committeeman Krebs seconded the motion.

Motion was carried by unanimous voice vote.



Mayor Barbagallo asked if anyone would like to speak.

Reginald Cole asked the question with regard to the Emergency Electric Resolution which was passed earlier at the meeting. Mayor Barbagallo responded that the town needed to move funds into the current account to pay any upcoming electric bills.

Committeeman Krebs made a motion to close public session.

Committeeman Lashendock seconded the motion

Motion was carried by a unanimous voice vote.



Deputy Mayor Soracco commented that school's PTA had received another award from the State and the Township Committee commends the PTA.



Committeeman Lashendock made a motion to adjourn meeting at 8:45p.m.

Deputy Mayor Soracco seconded the motion.

Motion was carried by unanimous voice vote.
